AS a family lawyer, I see many married couples that combine their business and personal lives by setting up a business together, or by bringing their spouse into their existing business. More commonly however, the end of the marriage signals the end of the working relationship, in which case important decisions need to be made regarding the future of the business. City firms will this week review policies on alcohol consumption and even relationships between staff, as the profession comes to terms with an unprecedented tribunal finding in the case of a former partner at magic circle firm Freshfields Bruckhaus Deringer.  Last week’s decision is believed to be the first time the tribunal has found misconduct in relation to sexual activity between colleagues. Freshfields has already started a firm-wide programme to ensure consistent standards of staff behaviour, with managers promising to make changes where this is not happening. A theme of the Beckwith case was alcohol consumption, whether celebrating on an [...]

In divorce proceedings, one of the very first things the domestic relations court must do is determine what assets are marital property subject to division, and what assets are separate property. A court must divide both marital and separate property equitably. Marital property is presumed to include all property acquired during the marriage or those assets produced or earned as a result of the parties’ mutual efforts during the marriage.  Generally, for property division purposes, property acquired before the marriage is considered separate property. However, this generalized rule does not automatically mean that just because one spouse holds title to [...]

Almost 60,000 retail jobs were lost in the UK over the past year, prompting calls from industry bodies for more action to help high streets, despite evidence that many of the people affected found alternative employment.  Retail employment is difficult to measure accurately because it is highly seasonal, but the British Retail Consortium, the retail trade association, estimates that a net 57,000 jobs were lost in the year to June.  The number, which was based on an analysis of the latest Office for National Statistics figures, contrasts with the wider picture of almost full employment in the UK, and the [...]
