Litigation Explained

The term “litigation,” which you may have heard of refers to the actual process of bringing a case before a judge or jury.

A definition of general litigation

“When a person, business, or entity enters into a lawsuit, whether they have filed the lawsuit or are responding to it, they are entering into a process known as…” is how the Legal Dictionary defines litigation. Lawsuits, often known as “actions,” are filed in order to enforce a specific right. In reality, the litigation process is a sequence of actions done to end the dispute, whether it be through court proceedings or settlement agreements.

Common types of general lawsuit

A general lawsuit comes in a variety of formats. Despite their differences, some of their characteristics may also be similar.

Plaintiff’s Personal Injury

According to the law, the plaintiff is the one who files a case against another individual. In UK law, the term itself is no longer used; instead, the party making the claim is now called a “claimant.” In personal injury cases, this is typically the individual who has been hurt and feels entitled to payment from the party they hold accountable for the harm.

Compensation may be sought in personal injury cases for a variety of different components of the accident-related injuries. They may consist of

Restitution for hardship and distress
Restitution for lost income and diminished quality of life
Property damage Unlawful death
Payment for the loss of earning potential
Bills and expenses related to medical care
Long-term or permanent disability
Anxiety

In these situations, the plaintiff, also known as the claimant, must show that the defendant’s conduct was the reason for the personal injury.

Compensation for Workers

For those who are murdered, maimed, or ill due to negligence, carelessness, or a lack of training at work, workers’ compensation is in existence.

People who sustain physical injuries at work typically file claims for workers’ compensation, but it can also be used to get compensation for problems including stress, bullying, discrimination, harassment, and wrongful termination.
