It was March 2016, and his new $41million yacht had just been named the overall winner in the annual Caribbean regatta devoted to the rich and famous.<\/p>\n

The beaming Macklowe looked every inch the part of a wealthy real estate mogul \u2013 the yacht shoes and salmon pants, the preppy sweater, the jaunty grasp of the microphone and the exotic location all dripped of fortune, not of a man who hadn\u2019t paid taxes in decades.<\/p>\n

Or maybe, actually, they did, given Macklowe\u2019s career in real estate development.<\/p>\n

Divorce lawyers for Macklowe\u2019s wife, Linda, have claimed in court that he has not paid taxes since 1983 \u2013 a revelation likely infuriating to the average taxpayer but all too common in the realm of high-stakes real estate, where millionaire developers keep getting richer through clever manipulation of tax loopholes.<\/p>\n

And details of the Macklowes\u2019 lavish lifestyle are likely to prove equally infuriating as their assets and expensive habits are laid bare in the acrimonious divorce proceedings between 80-year-old Harry and his 79-year-old wife of 58 years, Linda – whom he informed out of the blue last year that he was leaving in order to marry his younger, blonder French mistress, 62-year-old Patricia Landeau. It marked the end of an era for one of New York City\u2019s most long-lasting and recognizable couples in the cutthroat world of real estate and Manhattan high society.<\/p>\n

And, as husband and wife each fight to keep their properties, paintings and playthings – Mr Macklowe’s lawyer told DailyMail.com \u00a0they are due back in court next week – their divorce seems set to be just as ruthless as Mr Macklowe\u2019s business dealings. (He\u2019s perhaps most infamous for a 1985 incident in which his company demolished several welfare hotels overnight in midtown Manhattan only hours before a city statute made the move illegal \u2013 without even turning off the gas or electric beforehand, though Macklowe insisted he thought they were off.)<\/p>\n

The Macklowes are worth up to an estimated $2billion, but lawyers for Harry are trying to downplay his wealth \u2013 insisting he\u2019s worth negative $400million. Linda\u2019s team scoff at that and say he\u2019s used accounting tricks to hide his true value. She, however, may also be low-balling key assets she wants to keep \u2013 namely their palatial Plaza home and her behemoth art collection \u2013 which would mean she could win more of Harry\u2019s money; lawyers for her husband grilled her art expert in court on why he was not placing higher values on some well-known works.<\/p>\n

Harry and Linda own a multi-million-dollar estate in East Hampton on coveted Georgica Pond, where neighbors include Steven Spielberg, Ron Perelman and \u2013 as of last month \u2013 Beyonce and Jay Z, who snapped up a 12,000-square-foot property for $26million. Another famous neighbor, Martha Stewart, made headlines in the 1990s when she and the Macklowes got into a war about shrubbery, of all things. The Macklowes have had their property for nearly 30 years, and it includes a pool, main residence and, according to aerial photographs, an additional building; property site Zillow.com lists the off-market value for the estate at $7.6million.<\/p>\n

After Harry informed Linda he was leaving her for Ms Landeau, president of the French Friends of the Israel Museum in Jerusalem, the New York Post reported that he also shelled out nearly $11million for another home on Georgica Pond \u2013 across the water from the woman he\u2019s trying to divorce.\u00a0<\/p>\n

And the Macklowe homes in their beloved Manhattan are nothing short of New York City royalty. Ten years ago, they bought the 7th floor of the Plaza Hotel for $52million \u2013 making it the most expensive apartment in New York at the time. (The floor actually contained seven apartments, which they gutted and renovated.) Now it comprises a 14,000-square-foot condo with its own art gallery, dressing room, maid\u2019s room, library and 54 windows.<\/p>\n

The tax laws that favor real estate moguls<\/h3>\n

Various tax laws can work in the favor of high stakes real estate developers. In her book The Liar\u2019s Ball: The Extraordinary Saga of How One Building Broke the World\u2019s Toughest Tycoons, author Vicky Ward \u00a0explains Mr Macklowe’s use of\u00a0\u2018so-called depreciation, which declares that a building, no matter how profitable, wears out and declines to a value of zero over 39 years, which allows an investor to write off, as a tax loss, around 2.5 percent of the building\u2019s value every year. In other words, for every year he owned the GM building, Harry Macklowe was being credited with a tax loss of millions \u2013 even as its value went up by a billion dollars!\u2019<\/p>\n

Developers also famously make use of 1031 exchange laws, which allow a swap of one business or investment asset for another \u2013 with no capital gains tax, under the right set of circumstances. The \u2018name of the game\u2019 in the real estate industry, tax law expert Robert Wood tells DailyMail.com, \u2018is deferral.\u2019\u00a0<\/p>\n

There is also a \u2018\u201dsliver interest\u201d clause, known as a contribution\/debt financed distribution scheme,\u2019 Ms Ward explains in her book \u2013 wherein a seller avoids tax by acquiring shares in the buyer\u2019s company.\u00a0<\/p>\n<\/div>\n<\/div>\n

Jonathan Miller, who has been appraising property in New York City for more than three decades, testified in divorce proceedings that \u2018there aren\u2019t apartments like this configuration in the market,\u2019<\/p>\n

He added that the residence boasts \u2018probably the largest master bedroom I\u2019ve ever been in in my career.\u2019<\/p>\n

The couple \u2013 predictably \u2013 are feuding about the value of the Plaza digs, with Linda insisting it\u2019s worth $55million and Harry claiming it\u2019s worth nearly double that amount.<\/p>\n

Just a few blocks away, another property is proving to be particularly contentious in the couple\u2019s divorce. It\u2019s at 432 Park Avenue in one of Macklowe\u2019s developments, a swanky Rafael Vinoly-designed masterpiece which is now the tallest residential building in the Western Hemisphere. Harry and Linda purchased adjacent units on the 78th floor in 2013; her $14million apartment featured three bedrooms and three bathrooms, while his more expensive unit boasted four bedrooms and five bathrooms. The exact price Harry shelled out for his unit isn\u2019t known, though an apartment a floor below \u2013 with the same floorplan \u2013 sold last summer for more than $39million.<\/p>\n

Linda, however, has now filed suit against her husband, alleging Harry has downsized the property she bought \u2013 reducing it from 2,663 square feet to 1,766 and just one bedroom. She claims the lost space was added onto Harry\u2019s unit. A spokesman for Harry told The Real Deal that Linda \u2018has categorically stated that she did not want to live in, did not intend to live in and did not want to buy the apartment\u2019 \u2013 but her lawyers last week demanded a restraining order to stop the construction and changes to the 78th floor units. A source told DailyMail.com this week that no construction had been done at all, however.<\/p>\n

Their extravagant assets aren\u2019t limited to property, however; Linda has also amassed an art collection that is so massive that she has to keep many pieces in storage. A trustee of the Metropolitan Museum of Art and the Guggenheim \u2013 an honor she secured after donating $2.5million to the museum – Linda has been carefully curating and increasing her collection for decades, including works by artists such as Mark Rothko, Franz Kline, Andy Warhol and Gerard Richter. The collection is rumored to be valued at $1billion, though an art expert who testified for her \u2013 in keeping with the suspected low-balling strategy \u2013 claims it is worth just $625million.<\/p>\n

Author Vicky Ward, in her 2014 book The Liar\u2019s Ball: The Extraordinary Saga of How One Building Broke the World\u2019s Toughest Tycoons, quoted a friend of Linda\u2019s as describing her passion for art as an \u2018obsession for all the right reasons \u2026 it truly began to be the dominant, driving force in her life.\u2019<\/p>\n

Earlier in their marriage, if Linda \u2018liked something, she would make a commitment, and then she\u2019d bring Harry by later to see it,\u2019 her friend and confidant, art dealer Andrew Fabricant, says in Ward\u2019s book. \u2018And then a decision would be made.\u2019<\/p>\n

Harry had a different interest in the art, Ms Ward writes, quoting an art advisor: \u2018Harry loves [bidding at auction] for the theater, for the social aspects, \u2018cause everybody\u2019s there. And he likes to be seen out.\u2019<\/p>\n

\u2018An assistant helps her hang the artwork in their homes, schemed so minimalistically that the decor has been described by one regular visitor as \u201cthe bible by Florence Knoll \u2026 You could have opthalmological surgery on any given surface,\u201d\u2019 Ms Ward writes. \u2018Liz, their daughter, has been heard to joke that the kitchens in the Macklowe homes serve but one peculiar purpose: \u201cMy mother goes in there to open her mail.\u201d\u2019<\/p>\n

Following the Macklowes\u2019 purchase of the Plaza property in 2007, Ward writes, the couple began entertaining and showing off their art in their new apartment, giving a party every spring for 300 people \u2013 with the guest list including names such as the Lauders \u2013 of Estee Lauder cosmetic fame \u2013 and other movers-and-shakers in New York high society.<\/p>\n

And while the couple may have had varying interest in \u2013 and passion for \u2013 art, there was one uniting love that endured throughout their marriage: sailing, particularly their superyachts.<\/p>\n

For more than a decade, they devoted themselves to their 112-foot yacht, Unfurled, a sleek and luxurious three-cabin boat from respected Dutch shipyard Royal Huisman \u2013 which credited the Macklowes with \u2018pushing it to a higher level of custom construction,\u2019 according to MegaYacht News.<\/p>\n

Harry and Linda went sailing every summer, and the boat was one of their most prized possessions \u2013 but they eventually upgraded, commissioning a 150-foot yacht of the same name from shipyard Vitters which was delivered to them in 2015. The interior designer insisted the \u2018exceptional project defies convention in many ways.\u2019<\/p>\n

\u2018The owners are not only lifelong experienced and competitive yachtsmen, but also accomplished designers in their own right with enormous knowledge and appreciation of material, structure and architectural form,\u2019 designer Oliver Stirling wrote in the yacht\u2019s brochure. \u2018Adopting their Bauhaus objective of reconciling art and industry, and with their current iconic yacht as a benchmark, the designer\u2019s role throughout the project was to collaborate with them to develop design themes in minute detail and translate their creative thoughts and personal needs into the built form.\u2019<\/p>\n

The new Unfurled was a finalist for multiple Showboat Design Awards this year \u2013 in addition to winning the World Superyacht Awards 2016 in the category of \u2018sailing yacht 40m and above.\u2019<\/p>\n

The Macklowes enjoyed spending time together on the water, according to an unnamed friend in Vicky Ward\u2019s book \u2013 despite an often fractious relationship; \u2018They drive each other crazy and they can\u2019t live without each other,\u2019 Ms Ward quoted a friend as saying.<\/p>\n

The couple married in 1959 and had a son and daughter, and Linda seemed to be a behind-the-scenes force in Harry\u2019s real estate deals. \u2018In interviews, Harry always referred to his wife as better than him,\u2019 Ms Ward writes. \u2018\u201dShe\u2019s brilliant. She\u2019s just fantastic. I don\u2019t know why she married me, but she\u2019s extraordinary.\u201d\u2019\u00a0<\/p>\n

She stuck with Harry though his rollercoaster real estate moves; her husband earned a reputation early on as a risk-taker and a lovable rogue, making deals that left him on the brink of financial collapse multiple times \u2013 but always bouncing back. His overnight demolition of welfare hotels in 1985 sparked a backlash that even led to Mayor Ed Koch returning Macklowe\u2019s campaign contributions.<\/p>\n

In more recent years, he triumphantly bought the G.M. Building on Fifth Avenue, convinced the Apple store to take over the basement and spearheaded the construction of the now iconic glass sphere outside \u2013 before a deal that nearly spelled disaster. He bought seven buildings for $7billion in 2007, just before the markets crashed, taking on $6.8billion in short-term debt, including a personal loan of $1billion. He was unable to refinance the loans and ultimately had to sell the GM building of which he was so proud, though he retained an office in the space off Fifth Avenue which he has to this day. The deal drove a wedge between Harry and his son, whose side Linda allegedly took. But her husband again bounced back with 432 Park Avenue and its luxury residences, two of which are now playing such a central role in the Macklowe divorce proceedings.<\/p>\n

But just how much that fortune totals remains a serious bone of contention in the court proceedings.<\/p>\n

Harry, however, does not seem phased; he has even told marriage jokes to reporters outside of court since his wife filed for divorce last year. He\u2019s been seeing Ms Landeau \u2013 who is separated from her second husband \u2013 for an estimated four years and reportedly put her up in an apartment just a few minutes away from his home with Linda for the past two years; he claims he offered his wife half of his fortune for the divorce \u2013 a claim she denies \u2013 and he intends to marry Landeau once the marriage is over.<\/p>\n

\u2018I\u2019m getting a divorce because my life with my ex-wife was not a happy one,\u2019 he said last month.<\/p>\n

And while it may not have been happy, there\u2019s no denying it was lavish, and Linda continues spending money in the way to which she became accustomed. According to court proceedings, she\u2019s spent $700,000 in the last year and a half chartering boats because \u2018I was denied the use of my boat and I wanted to vacation and get some relaxation\u2019 \u2013 and she\u2019s also spent an estimated $7.5million on lawyers and experts as she pursues the divorce.<\/p>\n

The battle promises to be a long and involved one, as the real estate world, New York high society and the average onlooker simultaneously salivate over every detail \u2013 and, unlike the smooth sailing of Unfurled, the divorce is \u2018not going to be a pleasant experience,\u2019 the judge predicts.<\/p>\n
