The original image metadata in tmlImage is needed--><!-- for the InContent detail header which renders when the media size is inline or breakout.--><figcaption>\n<p class=\"tml-image--caption\" itemprop=\"caption\">Alyson Dorosky<\/p>\n<\/figcaption><\/figure>\n<\/div>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-b not-size-c not-size-d\" data-ad-group=\"in_content-0\"\/>\n<p>Let\u2019s dive in! <\/p>\n<h3 id=\"who-can-file-for-spousal-benefits-after-a-divorce\">Who can file for spousal benefits after a divorce?<\/h3>\n<p>A divorced person can collect Social Security benefits based on an ex-spouse\u2019s earnings record if they:  <\/p>\n<ul>\n<li>Were married for at least ten years.\u00a0<\/li>\n<li>Reached age 62.\u00a0<\/li>\n<li>Did not remarry.\u00a0<\/li>\n<li>Are eligible for a <a href=\"https:\/\/www.ssa.gov\/OACT\/COLA\/piaformula.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">primary insurance amount<\/a> (PIA) from Social Security that is less than one-half of the former spouse\u2019s PIA.*<\/li>\n<\/ul>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-c\" data-ad-group=\"in_content-0\"\/>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-d\" data-ad-group=\"in_content-0\"\/>\n<p>If you meet these criteria, you are entitled to benefits on a former spouse\u2019s record any time after the divorce <strong><em>if<\/em><\/strong> the ex-spouse has already applied for benefits.<\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-c not-size-d\" data-ad-group=\"in_content-0\"\/>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-b not-size-c not-size-d\" data-ad-group=\"in_content-1\"\/>\n<h3 id=\"what-if-my-ex-spouse-hasn-t-filed-for-benefits-yet\">What if my ex-spouse hasn\u2019t filed for benefits yet?<\/h3>\n<p>If you meet all the criteria above <strong>and<\/strong> have been divorced for at least two years, you are, in Social Security lingo, an Independently Entitled Divorced Spouse (IEDS). As an IEDS, you can file for divorced spousal benefits through the Social Security Administration (SSA) no matter if your ex-spouse has filed for benefits yet.<\/p>\n<h3 id=\"what-if-i-don-t-qualify-as-an-ieds\">What if I don\u2019t qualify as an IEDS?<\/h3>\n<p>You can still file for divorced spousal benefits <strong>after<\/strong> your former spouse files for their own benefits or when your magic IEDS two-year divorce timer is up.  <\/p>\n<h3 id=\"are-there-any-extra-filing-options-available-to-me-because-i-m-an-ieds\">Are there any extra filing options available to me because I\u2019m an IEDS?<\/h3>\n<p>Yes, a few unique filing options are available once you attain IEDS status. If you\u2019ve reached your <a href=\"https:\/\/www.ssa.gov\/OACT\/ProgData\/nra.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">full retirement age<\/a> and were 62 before Jan. 1, 2016, and your former spouse is at least 62 years old, you can file a restricted application for spousal benefits. <\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-c\" data-ad-group=\"in_content-1\"\/>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-d\" data-ad-group=\"in_content-1\"\/>\n<p>A restricted application allows applicants to choose one type of benefit they want to receive, even when they are eligible for multiple benefits. So, with a restricted application, you can file for divorced spousal benefits and accrue <a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/planner\/delayret.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">Delayed Retirement Credits<\/a> (or DRCs, which max out at age 70) before you file for your retirement benefits. <\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-c not-size-d\" data-ad-group=\"in_content-1\"\/>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-b not-size-c not-size-d\" data-ad-group=\"in_content-2\"\/>\n<p>If both ex-spouses are eligible to file restricted applications, they can concurrently file against each other\u2019s records simultaneously. Married couples aren\u2019t eligible to do this!<\/p>\n<p>Another benefit of IEDS status is that your spousal benefits are <strong>not<\/strong> reduced if your former spouse begins taking their benefits but has them reduced because of the <a href=\"https:\/\/www.ssa.gov\/oact\/cola\/rtea.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">earnings test<\/a>.** This is an advantage that married spouses don\u2019t have.  <\/p>\n<hr class=\"mm-horizontal-rule mm-horizontal-rule--hr1\"\/>\n<p class=\"is-aligned-center\">  <strong>Follow us on <a href=\"https:\/\/www.instagram.com\/retirementdaily\/\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">Instagram<\/a> and <a href=\"https:\/\/twitter.com\/RJPIII\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">Twitter<\/a>!<\/strong><\/p>\n<hr class=\"mm-horizontal-rule mm-horizontal-rule--hr1\"\/>\n<h3 id=\"will-i-receive-social-security-survivor-s-benefits-when-my-ex-spouse-dies\">Will I receive Social Security survivor&#8217;s benefits when my ex-spouse dies?<\/h3>\n<p>Divorced spouses, both IEDS and non-IEDS, are entitled to divorced survivor benefits at the death of their former spouse. To qualify, you must have been married for at least ten years, are at least 60 years old (or age 50, if disabled), and if you remarried, you didn\u2019t do so before you turned 60. <\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-c\" data-ad-group=\"in_content-2\"\/>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-d\" data-ad-group=\"in_content-2\"\/>\n<p>In this situation, deemed filing will not come into play. You can file for divorced survivor benefits <strong>only<\/strong> while allowing your own retirement benefits to grow by accruing as many DRCs as possible. <\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-c not-size-d\" data-ad-group=\"in_content-2\"\/>\n<p>It\u2019s important to note that there are different FRAs for survivor benefits than for retirement benefits. Knowing your survivor FRA is important to avoid a reduction in your survivor benefits, if possible. You can find the survivor <a href=\"https:\/\/www.ssa.gov\/benefits\/survivors\/1945s.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">FRA chart on the SSA\u2019s website<\/a>.  <\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-b not-size-c not-size-d\" data-ad-group=\"in_content-3\"\/>\n<p><strong>The bottom line is this.<\/strong><\/p>\n<p>Social Security rules are complicated. Are you divorced and trying to figure out your best filing strategy that earns you the maximum in benefits? The Social Security Administration will answer your questions, but they do not provide advice. It\u2019s wise to consult a financial advisor armed with software that, based on your situation, can show how much you\u2019d earn in various filing scenarios. <\/p>\n<p><em><strong>A terminology refresher:<\/strong>\u00a0<\/em><\/p>\n<p><em>*Primary insurance amount (PIA) is the term that describes what anyone eligible for Social Security benefits is entitled to upon reaching <a href=\"https:\/\/www.ssa.gov\/OACT\/ProgData\/nra.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">normal, or full, retirement age<\/a>. Full retirement age (FRA) varies depending on someone\u2019s birth month and year. Look yours up at <a href=\"https:\/\/www.ssa.gov\/benefits\/retirement\/planner\/agereduction.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">ssa.gov<\/a>.<\/em><\/p>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-c\" data-ad-group=\"in_content-3\"\/>\n<aside class=\"m-in-content-ad-row l-inline mm-in-content-ad-row--in-content not-size-a not-size-b not-size-d\" data-ad-group=\"in_content-3\"\/>\n<p><em> ** Social Security withholds benefits if someone collecting them is below normal retirement age and has earnings that exceed a limit set annually by the government from continuing to work. This is what the <a href=\"https:\/\/www.ssa.gov\/oact\/cola\/rtea.html\" rel=\"noopener\" onclick=\"return phoenixTrackClickEvent(this, event);\" target=\"_blank\">earnings test<\/a> refers to.
