This is an increase of 34 per cent per on the same period in 2016, and compares with 827,000 in the whole of 2008, at the onset of the financial crisis.<\/p>\n<p>The rise in court judgments is another indication of the high levels of unsecured debt weighing on British consumers, with Bank of England data showing that <a href=\"http:\/\/www.ft.com\/content\/7ded3efc-ee60-327b-8c39-dcbeabcd4770\" data-trackable=\"link\">borrowing through credit cards<\/a>, overdrafts and car loans has topped \u00a3200bn for the first time since the global crisis.<\/p>\n<p>Although <a href=\"http:\/\/www.ft.com\/content\/7d296f5f-5b5a-3d4b-9132-cba93c45e58b\" data-trackable=\"link\">UK unemployment<\/a> is at all-time lows, growth in real incomes and the savings rate have both deteriorated in recent months, suggesting household finances are worsening. Many economists are predicting a slowdown in what has been <a href=\"http:\/\/www.ft.com\/content\/9a01a418-9594-330f-92b0-4eed4bbe655d\" data-trackable=\"link\">robust consumer <\/a>spending.<\/p>\n<p>The court data do not identify who is litigating. But Malcolm Hurlston, who heads the Registry Trust, a non-profit organisation that collates the statistics for the Ministry of Justice, believes much of the rise is because of increased activity by debt collectors \u2014 known in industry parlance as debt recovery companies.<\/p>\n<p>Such companies buy portfolios of non-performing consumer debt from banks, finance companies and retailers. They pay a discount to the face value of the loans \u2014 typically about 10p on the pound \u2014 hoping to collect as much as 20p on the loan. <\/p>\n<blockquote class=\"n-content-pullquote\" aria-hidden=\"true\">\n<div class=\"n-content-pullquote__content\">\n<p>We make sure we pay the money directly to those whose debt we\u2019re paying off, just so they don\u2019t get distracted by William Hill [betting shop] on the way home<\/p>\n<\/div>\n<\/blockquote>\n<p>Companies use largely automated models for determining collection levels, based on large data sets such as the type of debt, the degree of contact with the borrower \u2014 and also whether the account has been \u201cworked\u201d by another debt collector.<\/p>\n<p>Collection involves contacting debtors via telephone or letter and, if unsuccessful, launching litigation and hiring bailiffs to enforce court awards.<\/p>\n<p>Michael Agboh-Davison of the StepChange debt charity, points to separate Ministry of Justice figures that show the number of bailiff warrants issued doubled from 98,000 in 2014 to 190,000 in 2016.<\/p>\n<p>He also cites an increase in activity by private sector bailiff companies such as Marston or Andrew Wilson &amp; Co, which are paid based on what they recover. \u201cYou can see the motivation for acting more assertively\u201d Mr Agboh-Davison said.<\/p>\n<p>Arrow Global, the UK\u2019s only listed debt collector, last week disclosed it had made a \u00a316m \u201cinvestment\u201d in litigation in the past three months to pursue collections from borrowers in its so-called back book.<\/p>\n<p>The increase in judgments \u201csounds alarming, but it could have a good outcome if it acts as a flag to another lender,\u201d said Peter Wallwork, chief executive of the Credit Services Association, the industry body that represents around 200 UK debt collectors that handle distressed consumer debts with a face value of \u00a365bn.<\/p>\n<p>Mr Hurlston agreed. \u201cLenders should go for judgments,\u201d he said. \u201cIt\u2019s in the public interest for people whose finances are in a mess to be helped not to borrow more.\u201d<\/p>\n<p>Another explanation for the rise in litigation, according to one debt recovery executive, is companies bringing forward court actions to avoid new forbearance rules imposed by the Financial Conduct Authority, which took effect on October 1.<\/p>\n<p>But Eddie Nott, managing director of 1st Credit, the UK operations of Intrum, Europe\u2019s largest debt recovery company, disagreed: \u201cWe don\u2019t believe rising county court judgments are the result of the pre-action protocol. Regulators would not look favourably on firms taking that approach.\u201d<\/p>\n<aside class=\"n-content-recommended\" role=\"complementary\" data-trackable=\"recommended\">\n<h3 class=\"n-content-recommended__title\">Recommended<\/h3>\n<\/aside>\n<p>Mr Nott also insisted litigation was a last resort. \u201cOnly when all attempts to establish a relationship with a customer and agree a way forward have failed should litigation be considered,\u201d he said.<\/p>\n<p>One of the main beneficiaries of the rise in court judgments is Non Standard Finance, a high-cost credit provider set up in 2015 by John van Kuffeler, who formerly ran the Bradford-based doorstep lender <a href=\"http:\/\/markets.ft.com\/data\/equities\/tearsheet\/summary?s=BBG000BDXB70\" data-symbol=\"BBG000BDXB70\" data-trackable=\"link\">Provident Financial<\/a>.<\/p>\n<p>His branch-based lending operation, Everyday Loans, targets \u201ccredit impaired\u201d consumers, who are unable to borrow from regular high street banks because of a county court judgment against them.<\/p>\n<p>Everyday Loans has increased its branch network by 50 per cent since 2016, choosing sites \u201cone or two streets behind the main shopping area, either on the ground floor or one floor up and usually close to the bus station or municipal car park\u201d, Mr Van Kuffeler says.<\/p>\n<p>He argues that companies such as Non Standard Finance provide a vital service for those unable to access regular credit. <\/p>\n<p>He added: \u201cAnd when we\u2019re dealing with debt consolidation, we make sure we pay the money directly to those whose debt we\u2019re paying off, just so they don\u2019t get distracted by William Hill [betting shop] on the way home.\u201d<\/p>\n<footer class=\"n-content-copyright\"><a href=\"http:\/\/help.ft.com\/help\/legal-privacy\/copyright\/copyright-policy\/\" data-trackable=\"link-copyright\">Copyright<\/a><br \/>\n\t\t\t\tThe Financial Times Limited 2017.
