The Chief Judge of Lagos State, Justice Opeyemi Oke, has urged lawyers to disabuse their minds from the notion that the practice of Alternative Dispute Resolution will cause them loss of revenue.<\/p>\n

She said rather, by embracing ADR, lawyers would be earning as much money as they earn in litigation, but with much less stress.<\/p>\n

The CJ noted that due to the stereotypic notion that lawyers must appear in court to earn high fees, many a young lawyer is rapidly ageing as a result of the stress that comes with court appearances and long arguments.<\/p>\n

Justice Oke, therefore, urged lawyers to embrace ADR more for the benefit of their clients and their own health.<\/p>\n

The Chief Judge gave this admonition last Wednesday at the 1st ADR Rountable for Lawyers organised by the Lagos Multi-Door Courthouse.<\/p>\n

The programme, which was chaired by retired Justice Adesuyi Olateru-Olagbegi, held in the foyer of the Lagos State High Court in Igbosere.<\/p>\n

Justice Oke recalled how a civil case involving a former Vice-President lasted in her court for 17 years, with the case file eventually getting burnt in a fire outbreak that gutted the courtroom.<\/p>\n

She said, \u201cI, personally, was frustrated that a case has lasted for 17 years in court and then we now had this fire incident and I believe that in a civilised society, that judge should not preside over that case again, because psychologically, you are stressed, emotionally, you are stressed, physically, you are stressed.\u201d<\/p>\n

She said she encouraged the parties to approach the Multi-Door Courthouse for mediation and, \u201cTo my utter surprise, they returned after one session, to report that the matter had been settled.\u201d<\/p>\n

She said lawyers needed a change of orientation to realise that by opting for ADR, they are helping the society and themselves.<\/p>\n

\u201cWhen the concept and the intrinsic values for disputants and lawyers are understood, then engagement in the process becomes profitable.<\/p>\n

\u201cOne doesn\u2019t have to be in court arguing everyday, and you have many young lawyers coming to court, and when they remove their wigs, you see that they are already growing grey hairs,\u201d the Chief Judge said.<\/p>\n

She added, \u201cAll these cases that you are bringing to court, take them to the Multi-Door Courthouse and it does not stop you from charging your fees. It does not take a kobo out of your fees at all. You are earning money and you are earning it without stress.\u201d<\/p>\n

One of the discussants, Mr. Richard Akintunde (SAN), said many lawyers, out of misconception, had termed ADR as Alarming Drop in Revenue.<\/p>\n

\u201cSo, they are very reluctant to embrace it, because they think they will get less fees, so, they try to sabotage or scuttle it, but if you package yourself, very well, ADR is not Alarming Drop in Revenue. It means you are able to add value to your client and your client sees you as a problem solver,\u201dAkintunde said.<\/p>\n

Another discussant, Mrs. Abimbola Akeredolu (SAN), said ADR is as much business as litigation and lawyers can earn well if they understand and play by the rules.<\/p>\n
