{"id":203639,"date":"2023-04-17T16:08:34","date_gmt":"2023-04-17T16:08:34","guid":{"rendered":"https:\/\/dominiclevent.com\/blog\/?p=203639"},"modified":"2023-04-17T16:08:34","modified_gmt":"2023-04-17T16:08:34","slug":"law-commission-to-examine-50-year-old-laws-on-finances-after-divorce-family-law-week","status":"publish","type":"post","link":"https:\/\/dominiclevent.com\/blog\/law-commission-to-examine-50-year-old-laws-on-finances-after-divorce-family-law-week\/","title":{"rendered":"Law Commission to examine 50-year-old laws on finances after divorce \u2013 Family Law Week"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"post-61815\"><!-- .entry-header --><\/p>\n<div class=\"entry-content\">\n<p>The Law Commission of England and Wales has launched <strong><a href=\"https:\/\/www.lawcom.gov.uk\/project\/financial-remedies-on-divorce\/\">a review of the laws which determine how finances are divided<\/a><\/strong> among couples after divorce or the dissolution of a civil partnership.<\/p>\n<p>Commissioned by the Ministry of Justice (MoJ), the new law reform project will consider the use of financial remedy orders: orders for financial provision between couples at the end of their marriage or civil partnership.<\/p>\n<p>Half a century after the passage of the Matrimonial Causes Act 1973, mirrored in the Civil Partnership Act 2004, the Government has asked the Law Commission to review whether the current law is working effectively, and delivering fair and consistent outcomes for divorcing couples.<\/p>\n<p>In its review, the Commission will carry out a detailed analysis of the current laws on financial remedies, to determine whether there are problems with the current framework which require law reform, and what the options for reform might look like.<\/p>\n<p>The Law Commission\u2019s work will consider the financial orders made by courts in England and Wales, as well as the law in other countries.
