For example, <b>Imperial Tobacco<\/b> <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=3133891750&amp;u=https%3A%2F%2Fcqct.qc.ca%2FDocuments_docs%2FDOCU_2024%2FMOTION_24_03_11_StayExtension_ImperialTobacco_11_MAR_2024_ANNOTE.pdf&amp;a=introduced\" target=\"_blank\" rel=\"nofollow noopener\">introduced<\/a> &#8220;<b>Zonnic<\/b>&#8221; nicotine pouches in <span class=\"xn-chron\">October 2023<\/span> that to date have generated net revenues of <span class=\"xn-money\">$4.5 million<\/span> across <span class=\"xn-location\">Canada<\/span> and that <span class=\"xn-location\">Quebec<\/span> pharmacists <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=2120785998&amp;u=https%3A%2F%2Fwww.opq.org%2Fnouvelles%2Fpochettes-de-nicotine-si-vous-les-tenez-en-pharmacie-conservez-les-derriere-le-comptoir%2F&amp;a=say+\" target=\"_blank\" rel=\"nofollow noopener\">say <\/a>are being purchased by young people. Meanwhile, <b>Rothmans, Benson &amp; Hedges<\/b> <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=3544664276&amp;u=https%3A%2F%2Fcqct.qc.ca%2FDocuments_docs%2FDOCU_2024%2FMOTION_24_03_11_MotionRecord_RBH_11_MAR_24_ANNOTE.pdf&amp;a=began+distributing\" target=\"_blank\" rel=\"nofollow noopener\">began distributing<\/a> &#8220;<b>VEEV<\/b>&#8221; vaping products in <span class=\"xn-chron\">October 2021<\/span>, a disposable version in <span class=\"xn-chron\">July 2022<\/span>, and a new heated tobacco product (&#8220;<b>IQOS ILUMA<\/b>&#8220;) in <span class=\"xn-chron\">November 2023<\/span>. These are among the many new products introduced by the companies since <span class=\"xn-chron\">March 2019<\/span>, including <b>Imperial Tobacco&#8217;s <\/b>range of disposable e-cigarettes, <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=1749711584&amp;u=https%3A%2F%2Fsmoke-free-canada.blogspot.com%2F2022%2F08%2Fbats-vuse-in-canada-more-flavours-and.html&amp;a=new+flavours+\" target=\"_blank\" rel=\"nofollow noopener\">new flavours <\/a>and nicotine strengths.<\/p>\n<p><b><i>A court process that protects the &#8220;normal&#8221; business operations of Big Tobacco <\/i><\/b><\/p>\n<p>The motions filed for Monday&#8217;s hearing show the extent to which the <b>CCAA<\/b> process is advantageous for tobacco manufacturers (see <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=739029884&amp;u=https%3A%2F%2Fcqct.qc.ca%2FCommuniques_docs%2F2024%2FPRSS_24_03_25_TobaccoLitigation_5yearsOfStays_APPENDIX.pdf&amp;a=this+appendix\" target=\"_blank\" rel=\"nofollow noopener\">this appendix<\/a> for complete excerpts). In fact, <b>Imperial Tobacco<\/b> <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=4160196464&amp;u=https%3A%2F%2Fcqct.qc.ca%2FDocuments_docs%2FDOCU_2024%2FMOTION_24_03_11_StayExtension_ImperialTobacco_11_MAR_2024_ANNOTE.pdf&amp;a=concedes\" target=\"_blank\" rel=\"nofollow noopener\">concedes<\/a> that, &#8220;<i><u>overall, there has been negligible disruption of the Applicants&#8217; business operations<\/u><\/i>&#8221; and that it is precisely in their interest to be engaged in a &#8220;<i><u>process with the overriding objective of preserving the value of their business<\/u>.&#8221; <\/i>For its part, <b>Rothmans, Benson &amp; Hedges<\/b> writes that &#8220;<i>a global settlement that addresses all pending and potential Tobacco Claims is <u>the best outcome for the parties<\/u>&#8220;<\/i> and that it &#8220;<i>RBH will continue to operate its business in the normal course<\/i>.&#8221; (Incidentally, the company is seeking an exemption to allow lawsuits involving its employees to proceed, while all other legal action against it remains suspended). Finally, <b>JTI-Macdonald<\/b> <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=1548812580&amp;u=https%3A%2F%2Fcqct.qc.ca%2FDocuments_docs%2FDOCU_2024%2FMOTION_24_03_00_en_ca_insolv_JTI_MotionRecordreturnableMarch252024_ANNOTE.pdf&amp;a=adds\" target=\"_blank\" rel=\"nofollow noopener\">adds<\/a> that the company <u>favours the <b>CCAA<\/b> process in order to &#8220;<i>maintain the status quo of its operations<\/i><\/u><i>&#8221; <\/i>and<i> &#8220;preserve going concern value<\/i> &#8220;, and that <u>a further stay will enable it &#8220;<i>to continue to operate in the ordinary course<\/i>&#8221; of business<\/u>.<\/p>\n<p><i>&#8220;These secret negotiations among provincial governments and tobacco companies have now dragged on for more than five years. By giving explicit permission for the companies to operate their &#8216;business as usual&#8217;, these governments have been complicit in the recruitment of another generation of nicotine addicts. Indeed, there are <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=4243961524&amp;u=https%3A%2F%2Fsmoke-free-canada.blogspot.com%2F2023%2F10%2Ftrends-in-overall-nicotine-use-in-canada.html&amp;a=more+nicotine+users+in+Canada\" target=\"_blank\" rel=\"nofollow noopener\">more nicotine users in <span class=\"xn-location\">Canada<\/span><\/a><\/i> <i>today than there were when these insolvency proceedings began in <span class=\"xn-chron\">March 2019<\/span>,&#8221;<\/i> underscores <b><span class=\"xn-person\">Cynthia Callard<\/span>, Executive Director of Physicians for a Smoke-Free Canada<\/b>. &#8220;<i>How is it our governments are engaged in a process that prioritizes the financial health of cigarette manufacturers at the expense of the health and well-being of the public and the right to justice of victims?<\/i>&#8220;<\/p>\n<p><b><i>Ensuring an outcome that&#8217;s in the public&#8217;s interest<\/i><\/b><\/p>\n<p>Notwithstanding the outrageous delays incurred under this process, <b><span class=\"xn-person\">Les Hagen<\/span>, Executive Director of ASH-<span class=\"xn-location\">Canada<\/span> <\/b>insists that <i>&#8220;the provinces should use the historic power imbalance conferred on them by the threat of insolvency for the tobacco giants to demand groundbreaking concessions that will prevent the recruitment of new victims. No settlement agreement should ever be based on the need to entrap future addicts to pay monetary penalties to governments. All provinces have hidden behind an <span>alleged<\/span> confidentiality obligation to avoid stating their plans for the future of the tobacco industry in <span class=\"xn-location\">Canada<\/span>. Under this shroud, it is difficult to believe the current process will serve the public interest.<\/i><\/p>\n<p><i>&#8220;The current mediation process is not mandatory and there is no reason to sustain this deadly industry. Given the value of their respective claims, <span class=\"xn-location\">Quebec<\/span> and <span class=\"xn-location\">Ontario<\/span> could jointly suspend the CCAA proceedings should the mediators propose a settlement that is not in the public&#8217;s interest. In the absence of an agreement that minimizes further damage, the infrastructure and trademarks of the bankrupt tobacco companies could be transferred to a new entity that will prioritize health over profits. For example, a suitable government agency or nonprofit organization could be mandated to shrink the tobacco and recreational nicotine markets,<\/i>&#8221; concludes <b>Mr. Hagen<\/b>.<\/p>\n<p>An <a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=4123258-1&amp;h=3491189541&amp;u=https%3A%2F%2Fcqct.qc.ca%2FDocuments_docs%2FDOCU_2020%2FMEMO_20_08_06_Report_Krueger_EconomicBenefits_ReducedSmoking.pdf&amp;a=economic+analysis\" target=\"_blank\" rel=\"nofollow noopener\">economic analysis<\/a> by <b>H. Krueger and Associates Inc<\/b>. shows that the savings to the healthcare system resulting from a significant contraction in the tobacco market would far exceed any realistic compensation amounts for the provinces.?According to this study, <b><span class=\"xn-location\">Quebec<\/span><\/b> and <b><span class=\"xn-location\">Ontario<\/span><\/b> would generate health savings of <span class=\"xn-money\">$22.2 billion<\/span> and <span class=\"xn-money\">$26.1 billion<\/span> respectively, if smoking prevalence fell to less than 5% by 2035.
