{"id":233287,"date":"2024-06-17T17:59:20","date_gmt":"2024-06-17T17:59:20","guid":{"rendered":"https:\/\/dominiclevent.com\/blog\/?p=233287"},"modified":"2024-06-17T17:59:20","modified_gmt":"2024-06-17T17:59:20","slug":"wolverhampton-guilty-verdicts-raise-issue-of-naming-child-killers","status":"publish","type":"post","link":"https:\/\/dominiclevent.com\/blog\/wolverhampton-guilty-verdicts-raise-issue-of-naming-child-killers\/","title":{"rendered":"Wolverhampton guilty verdicts raise issue of naming child killers"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"dcr-1dd4wv0\">The guilty verdicts in the trial of <a href=\"https:\/\/www.theguardian.com\/uk-news\/article\/2024\/jun\/10\/two-boys-12-found-guilty-of-shawn-seesahai-in-wolverhampton\" data-link-name=\"in body link\">two 12-year-olds for killing Shawn Seesahai<\/a> in Wolverhampton, puts them among the UK\u2019s youngest convicted murderers, and leaves the judge with key decisions to make.<\/p>\n<p class=\"dcr-1dd4wv0\">Before deciding the minimum sentence to impose on the boys, Mrs Justice Tipples will have to decide whether they should be named.<\/p>\n<p class=\"dcr-1dd4wv0\">The defendants are believed to be the youngest convicted murderers since Robert Thompson and Jon Venables, both 11 when they were <a href=\"https:\/\/www.theguardian.com\/uk\/bulger\" data-link-name=\"in body link\">found guilty in 1993 of killing two-year-old James Bulger<\/a>. On that occasion, amid widespread revulsion at their actions, the judge took the decision to end their anonymity and their photographs became indelibly etched in the public\u2019s consciousness.<\/p>\n<p class=\"dcr-1dd4wv0\">Judges in England and Wales routinely use their discretionary powers <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1999\/23\/section\/45\" data-link-name=\"in body link\">under the Youth Justice and Criminal Evidence Act (YJCEA)<\/a> to prevent under-18s tried in adult courts from being named until adulthood.<\/p>\n<p class=\"dcr-1dd4wv0\">However, in exceptional instances, such as the Bulger case, orders are removed at the end of the trial, usually after a media application. Whatever the stage of proceedings, the YJCEA says the public interest in naming a child defendant should be weighed against their welfare.<\/p>\n<figure id=\"96b75703-1ab1-4dac-b68c-9a6f59e48a97\" class=\"dcr-1dd4wv0\">Kym Darby, chair of the James Bulger Foundation, said James\u2019s mother, Denise Fergus, had been \u201cknocked for six\u201d by the <a href=\"https:\/\/www.theguardian.com\/uk\/wolverhampton\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Wolverhampton<\/a> case, adding: \u201cI know that she would want them to be named.\u201d She said Fergus believed the names of children convicted of murder should \u201cbe everywhere for what they have done\u201d.<\/p>\n<p class=\"dcr-1dd4wv0\">However, Dr Kathy Hampson, a senior lecturer in criminology at Aberystwyth University, said that naming child killers forever associated them and their photographs with their victims \u2013 <a href=\"https:\/\/news.sky.com\/story\/scarlett-jenkinson-and-eddie-ratcliffe-named-as-brianna-gheys-teenage-killers-but-victims-father-disagrees-with-judges-decision-13061367\" data-link-name=\"in body link\">Brianna Ghey\u2019s father did not want her murderers named for that reason<\/a> \u2013 and could dominate media coverage.<\/p>\n<p class=\"dcr-1dd4wv0\"><a href=\"https:\/\/www.judiciary.uk\/guidance-and-resources\/reporting-restrictions-in-the-criminal-courts-fifth-edition-update\/\" data-link-name=\"in body link\">Guidance for judges<\/a> states: \u201cPrior to and during the trial, the welfare of the defendant is likely to take precedence over the public interest in publication, whereas after conviction, the age of the offender and the seriousness of the crime will be particularly relevant \u2026 [and] the balance will invariably have shifted in favour of publication, albeit not necessarily decisively so.\u201d<\/p>\n<figure cases such as that of <a href=\"https:\/\/www.theguardian.com\/uk-news\/2024\/feb\/02\/brianna-ghey-murderers-named-sentenced-to-life-in-prison\" data-link-name=\"in body link\">Brianna\u2019s killers<\/a>, Scarlett Jenkinson and Eddie Ratcliffe,<strong> <\/strong>both 16, and <a href=\"https:\/\/www.theguardian.com\/uk-news\/2014\/nov\/03\/will-cornick-model-student-planned-ann-maguire-murder-three-years\" data-link-name=\"in body link\">William Cornick<\/a>, who was 15 when he killed his teacher, Ann Maguire, during a lesson.<\/p>\n<p class=\"dcr-1dd4wv0\">In the Ghey case, <a href=\"https:\/\/www.theguardian.com\/uk-news\/2023\/dec\/21\/teenagers-convicted-of-brianna-ghey-murder-can-be-named-judge-rules\" data-link-name=\"in body link\">Mrs Justice Yip said<\/a> there was a \u201cstrong public interest in full and unrestricted reporting of what is plainly an exceptional case \u2026 The public will naturally wish to know the identities of the young people responsible as they seek to understand how children could do something so dreadful.\u201d<\/p>\n<p class=\"dcr-1dd4wv0\">With respect to Cornick, <a href=\"https:\/\/www.theguardian.com\/uk-news\/2014\/nov\/05\/naming-will-cornick-deterrent-effect-judge-ann-maguire\" data-link-name=\"in body link\">Mr Justice Coulson said<\/a>: \u201cIn my view, naming him has a clear deterrent effect. On the contrary it might, by garnering significant publicity, glorify RXG and encourage others to do the same thing.\u201d<\/p>\n<p class=\"dcr-1dd4wv0\">The risk of the identity of child offenders being circulated, thereby limiting the effect of an anonymity order, has always existed but it has been amplified exponentially by social media. While Brianna\u2019s killers had been identified unlawfully online Yip said, in line with judicial guidance, that \u201cdoes not provide a proper basis for removing the reporting restrictions\u201d.<\/p>\n<p class=\"dcr-1dd4wv0\">A factor raised by Yip in favour of removing anonymity was that, under the law, the killers would be able to be named when they turn 18. A lifelong injunction \u2013 known as a \u201cVenables jurisdiction\u201d after it was granted in the Bulger case \u2013 can be issued but is \u201crare and exceptional\u201d, generally used to protect new identities of notorious offenders on release.
