Juries are directed to convict a defendant only if they are sure of their guilt. But terrible miscarriages of justice can and do happen.<\/p>\n<p class=\"dcr-1bgz3hb\">There are supposed to be safeguards in the system to help expose these. Yet a new independent review of the Criminal Cases Review Commission\u2019s handling of the case of Andrew Malkinson \u2013 who was imprisoned for 17 years for a violent rape he did not commit \u2013 shows just how <a href=\"https:\/\/www.theguardian.com\/law\/article\/2024\/jul\/18\/catalogue-of-failures-watchdog-missed-chances-to-help-andrew-malkinson-report-finds\" data-link-name=\"in body link\">threadbare that safety net<\/a> really is.<\/p>\n<p class=\"dcr-1bgz3hb\">Malkinson was convicted of rape in 2004. His <a href=\"https:\/\/www.theguardian.com\/uk-news\/2023\/jul\/26\/appeal-court-overturns-manchester-rape-conviction-of-man-who-spent-17-years-in-jail-andrew-malkinson\" data-link-name=\"in body link\">conviction was fundamentally unsafe<\/a> on many counts: Greater Manchester police failed to disclose important evidence that undermined the case against him, including photographic evidence that supported the victim\u2019s memory that she caused a \u201cdeep scratch\u201d to her attacker\u2019s cheek (Malkinson had no marks on his face when he was seen by the police the next day) and the fact that a key witness who identified him was a heroin addict with multiple criminal convictions who only came forward the night he was arrested for another crime. Greater Manchester police also destroyed key pieces of clothing from the victim while a preservation order was still in place, which could have jeopardised the DNA testing that later proved Malkinson\u2019s innocence. There <a href=\"https:\/\/www.theguardian.com\/law\/2023\/aug\/15\/dna-and-injustice-a-timeline-of-the-andrew-malkinson-case\" data-link-name=\"in body link\">were further failings<\/a> three years after his conviction when DNA evidence from another man was found on the victim\u2019s clothing as part of a forensic review of several cases; both the police and the Crown Prosecution Service were notified but failed to act.<\/p>\n<p class=\"dcr-1bgz3hb\">The <a href=\"https:\/\/www.theguardian.com\/law\/criminal-cases-review-commission\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Criminal Cases Review Commission<\/a> is the independent body that acts as a gatekeeper in determining whether potentially unsafe convictions should be referred to the court of appeal for review. Malkinson applied to the commission twice in 2009 and\u00a02018 on the basis of this extra evidence to have his case reviewed.<\/p>\n<aside class=\"dcr-1a9izlf\" data-spacefinder-role=\"supporting\">\n<blockquote class=\"dcr-zzndwp\"><p>The CCRC has considerable investigatory powers and should have uncovered disclosure failures by Greater Manchester police<\/p><\/blockquote>\n<\/aside>\n<p class=\"dcr-1bgz3hb\">The CCRC has considerable investigatory powers and could and should have uncovered disclosure failures by Greater Manchester police that themselves would have been enough to render his conviction unsafe, and commissioned further DNA testing. It took the involvement of the charity Appeal with Malkinson\u2019s case over a period of years \u2013 commissioning its own DNA testing and uncovering the disclosure failures after a legal battle for the police file \u2013 to eventually convince the CCRC to refer the case to the court of appeal in 2023 after a third application, which finally led to his conviction being overturned.<\/p>\n<p class=\"dcr-1bgz3hb\">There was no apology from the CCRC after Malkinson\u2019s conviction was overturned. \u201cWe recognise Andrew had had a very long journey to clear his name, but sadly the evidence that led to the court overturning his conviction only became available years after his conviction,\u201d said its chair Helen Pitcher, a statement that scandalously sweeps under the carpet the CCRC\u2019s devastating failure to use its powers to bring that evidence to the surface.<\/p>\n<p class=\"dcr-1bgz3hb\">Last October, <a href=\"https:\/\/www.gov.uk\/government\/news\/judge-appointed-to-chair-independent-malkinson-inquiry\" data-link-name=\"in body link\">Sarah Munro KC was appointed by the lord chancellor<\/a> to chair an ongoing public inquiry into the wrongful conviction of Malkinson. The CCRC also last year commissioned its own independent review by Chris Henley KC into its handling of the case; that review <a href=\"https:\/\/www.theguardian.com\/law\/article\/2024\/jul\/18\/catalogue-of-failures-watchdog-missed-chances-to-help-andrew-malkinson-report-finds\" data-link-name=\"in body link\">was published last week<\/a>, together with the CCRC\u2019s response.<\/p>\n<p class=\"dcr-1bgz3hb\">Its <a href=\"https:\/\/cloud-platform-e218f50a4812967ba1215eaecede923f.s3.amazonaws.com\/uploads\/sites\/5\/2024\/07\/Integrated-Report-Response-Redacted-Copy.pdf\" data-link-name=\"in body link\">findings are damning<\/a>. Henley says that Malkinson\u2019s conviction would have been overturned 10\u00a0years earlier if the CCRC had properly understood the implications of a similar miscarriage of justice, involving another <a href=\"https:\/\/www.theguardian.com\/uk-news\/2013\/dec\/16\/wrongly-jailed-victor-nealon-free-streets-postman\" data-link-name=\"in body link\">innocent man, Victor Nealon<\/a>, convicted of rape in 1997 \u2013 a case in which the commission had made the same kind of errors. The CCRC consistently failed to apply the correct test in determining whether Malkinson\u2019s case should be referred to the court of appeal on the basis of the evidence. Henley concludes that this test \u201ceven now is not being applied properly, and that the CCRC is taking too cautious an approach. This needs urgently to change.\u201d<\/p>\n<p class=\"dcr-1bgz3hb\">He finds that the CCRC failed Malkinson and says it owes him a wholehearted apology. He quotes Pitcher claiming as recently as 2021 that \u201cwhen we do [make mistakes] we stick our hands up as soon as possible\u201d but says that this simply has not happened. In fact, the CCRC misleadingly implied in its statement the day the court of appeal overturned the conviction that it was its own forensic testing that had been responsible. It should not have taken Henley\u2019s report to force the apology from Pitcher that was so obviously due to Malkinson. In its response to Henley\u2019s review, the CCRC defensively cites academic evidence that found \u201cno evidence that we were missing opportunities to refer cases to appeal\u201d. If Pitcher felt any contrition about the failings on her watch, she would pre-empt this process by offering her resignation.<\/p>\n<p class=\"dcr-1bgz3hb\">We will have to await the findings of the public inquiry to learn just how extensively Malkinson was failed by the various institutions of the criminal justice system, from the police to the prosecution service. But Henley\u2019s review highlights that the CCRC is not fit for its critical purpose of serving as a safeguard against miscarriages of justice.
