So, I spoke to three IP attorneys to better understand the potential risks associated with using artificial intelligence in filmmaking.<\/p>\n

“The integration of AI in film production is not just changing how we create; it’s fundamentally altering the legal landscape of intellectual property,” says Kayla Jimenez, partner at US IP Attorneys, P.C. This seismic shift is forcing filmmakers to grapple with complex questions of authorship, copyright and fair use\u2014issues that could make or break careers and studios alike.<\/p>\n

At the heart of the matter lies a deceptively simple question: Who owns the rights to AI-generated content? The answer, unfortunately, is far from straightforward. “U.S. copyright law currently requires human authorship,” Jimenez explains. “This means purely AI-generated works aren’t eligible for copyright protection.”<\/p>\n

Blessing Gana, a Canadian barrister and solicitor specializing in corporate and entertainment law at the Law Offices of Blessing Gana, adds an international perspective, stating that most countries who are signatories to the Berne Convention work within the premise that human-made original creations have automatic copyright protection. According to Gana, \u201cThe role of AI algorithms in composing creative leads to a paradigm shift that challenges this presumption.”<\/p>\n

Use too little, and you risk falling behind in an increasingly competitive industry. Rex Brabson, founder of T-REx Law, P.C., offers a guiding principle: “The more creative input a human provides, the more likely they are to be granted copyright protection.”<\/p>\n

This nuanced approach is already being tested in high-profile cases. The ongoing litigation involving Stability AI, Midjourney and DeviantArt<\/a> alleges unauthorized use of copyrighted images in AI training. Meanwhile, Thomson Reuters Enterprise Centre GmbH v. ROSS Intelligence Inc.<\/a> is set to address whether training AI on copyrighted materials constitutes infringement. The outcomes of these cases could reshape the entire AI landscape in entertainment.<\/p>\n

Beyond Copyright: The Trademark Trap<\/h3>\n

While copyright issues dominate the conversation, AI’s impact on trademark law is equally significant. “Using AI to create logos or visual elements can inadvertently mimic existing trademarks,” Jimenez warns. Unlike copyright infringement, which requires a direct copy, trademark cases hinge on the potential for consumer confusion. A logo that’s simply too similar to an existing trademark could land a filmmaker in hot water, regardless of whether AI or human hands created it.<\/p>\n

Fair Use in the Age of AI<\/h3>\n

As if copyright and trademark issues weren’t complex enough, the concept of fair use becomes even murkier in the AI era. Courts traditionally consider factors such as whether a new work is transformative and its impact on the market for the original work. The New York Times’ recent lawsuit against OpenAI, challenging the use of its content to train AI models, may provide some answers. As these cases unfold, they’ll likely redefine the boundaries of fair use for the AI age.<\/p>\n

Gana notes that fair use will be a major defense for AI developers in these cases. “The court typically balances four factors: the purpose and character of the use, the nature of the copyrighted work, the amount used, and the effect on the potential market for the copyrighted work,” she explains.<\/p>\n

Protecting Your Vision: A Filmmaker’s Guide<\/h3>\n

Given these risks, what can filmmakers do to protect themselves? Jimenez, Brabson and Gana offer several key strategies:<\/p>\n

  5. Document all your creative input when using AI tools, as this may be crucial in copyright disputes.<\/li>\n
  6. Embed your work with blocking technology to prevent unauthorized AI training.<\/li>\n
  7. Consider licensing models based on music royalty collection systems for AI use of creative works.<\/li>\n<\/ol>\n

    “Think of it as insurance for your creativity,” Brabson says. “These steps might seem cumbersome now, but they could save you millions in potential lawsuits down the line.”<\/p>\n
