The serious case review that followed their deaths, in a house fire deliberately started by their father, concluded that the court should have considered suspending the boys\u2019 contact with him. Ms Throssell had left the family home due to domestic violence and had warned that he\u00a0had told her he could understand why men killed their children.<\/p>\n<p class=\"dcr-1n1orvu\">Case reviews are supposed to be learned from. But a decade later, there is plenty of evidence that poor decisions are still being made when domestic violence victims come before family judges. Last month a convicted rapist, Kristoffer White, was <a href=\"https:\/\/www.theguardian.com\/society\/2024\/sep\/14\/father-who-is-convicted-rapist-stripped-of-parental-responsibility-for-daughter\" data-link-name=\"in body link\">stripped of parental responsibility<\/a> for his daughter \u2013 but only after the child\u2019s mother appealed an earlier ruling that permitted unsupervised contact.<\/p>\n<p class=\"dcr-1n1orvu\"><a href=\"https:\/\/www.womensaid.org.uk\/wp-content\/uploads\/2016\/01\/Child-First-Nineteen-Child-Homicides-Report.pdf\" data-link-name=\"in body link\">Nineteen children<\/a> were killed by fathers who were allowed contact with them between 2005 and 2015, in England and Wales. Others have been harmed. A <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/5ef3dcade90e075c4e144bfd\/assessing-risk-harm-children-parents-pl-childrens-cases-report_.pdf\" data-link-name=\"in body link\">report<\/a> from the Ministry of Justice in 2020 contained 72 recommendations aimed at tilting the culture of the\u00a0family court away from a presumption of contact with both parents, towards a greater emphasis on safety. But these have not all been implemented, while legal aid cuts continue to have adverse effects. A\u00a0domestic abuse perpetrators\u2019 programme abolished in 2022 has yet to be replaced.<\/p>\n<p class=\"dcr-1n1orvu\">More positive recent changes include the inclusion of <a href=\"https:\/\/www.theguardian.com\/lifeandstyle\/2024\/mar\/23\/but-he-didnt-hit-you-did-he-inside-the-coercive-control-courtroom\" data-link-name=\"in body link\">coercive control<\/a> in 2021\u2019s domestic abuse act. This was part of a broader shift towards a more holistic understanding of the dynamics of abusive relationships. But it is hard to tell to what extent this is reflected in the courts or the Children and Family Court Advisory and Support Service \u2013 which represents children\u2019s interests in family law cases, and has also faced criticism for past failings.<\/p>\n<p class=\"dcr-1n1orvu\">Nicole Jacobs, the domestic abuse commissioner for England and Wales, is due to <a href=\"https:\/\/domesticabusecommissioner.uk\/family-court\/\" data-link-name=\"in body link\">lead a study<\/a> on the way abuse allegations are handled. In July, Sir Andrew McFarlane, the family court\u2019s president, reported that <a href=\"https:\/\/www.judiciary.uk\/guidance-and-resources\/a-view-from-the-presidents-chambers-july-2024\/\" data-link-name=\"in body link\">trials in two areas<\/a> of a new, child\u2011centred and less adversarial approach to private law disputes had been \u201cfar more successful than even its most ardent supporters would have anticipated\u201d. Another pilot, of <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2024\/jan\/31\/fought-family-courts-journalists-report-hearings\" data-link-name=\"in body link\">family court reporting by the press<\/a> and legal bloggers, has been <a href=\"https:\/\/www.thebureauinvestigates.com\/blog\/2024-03-28\/tbij-hires-uks-first-full-time-family-court-reporter\/\" data-link-name=\"in body link\">extended<\/a> beyond its initial three locations.<\/p>\n<p class=\"dcr-1n1orvu\">Huge gaps in the published data remain a sticking-point. Case numbers are in the public domain. In 2022 there were <a href=\"https:\/\/domesticabusecommissioner.uk\/wp-content\/uploads\/2023\/10\/DAC_Famliy-Court-Report_Oct-2023.pdf\" data-link-name=\"in body link\">52,204 new private law cases<\/a> involving children, and<a href=\"https:\/\/data.justice.gov.uk\/courts\/family-courts\" data-link-name=\"in body link\"> 16,384 public law cases<\/a> where children\u2019s services were involved. But statistics on children\u2019s involvement in proceedings and on the orders made by judges \u2013 and how these vary over time and between regions \u2013 are lacking. So are many other details that could help inform, and improve, policy and practice in a system entrusted with difficult and highly sensitive decisions. The risks to families in which fathers are domestic abusers, or sex\u00a0offenders, remain the most <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-68830796\" data-link-name=\"in body link\">serious concerns<\/a>.<\/p>\n<p class=\"dcr-1n1orvu\">Senior judges have indicated their support for a more open system. But a lack of resources hinders progress. The anonymisation unit that was supposed to enable more judgments to be published does not exist, due to a lack of funding.
