The<br \/>\nancient Greeks called it the art of rhetoric, and it was considered<br \/>\nan important field of study, well into the 19th century. In the<br \/>\nmodern world, few people study rhetoric or consciously apply labels<br \/>\nto their forms of speech. But rhetorical devices still exist. They<br \/>\nremain effective, and many are commonly used in the courtroom. Here<br \/>\nare three basic ones: lists, anaphora and rhetorical questions.<\/p>\n<p>First: <strong>lists<\/strong>, a simple and effective way to<br \/>\ncommunicate information is to present it in the form of a list. We<br \/>\nuse lists every day in our lives to organize information, things to<br \/>\ndo, shopping lists and make it easier to understand and remember.<br \/>\nThe courtroom is no different. Use verbal and written lists to<br \/>\norganize and communicate your points. Almost any kind of argument<br \/>\ncan be turned into a list. There are seven key pieces of evidence<br \/>\nfound in the victim&#8217;s bedroom:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>First, the defendant left a fingerprint on the door.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Second, he left several hairs on the pillow.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Third and so forth and so forth.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Or how about there are four things that the government or the<br \/>\nplaintiff must prove. First, second, third and so on.<\/p>\n<p>Lists can also be turned into visual aids and should be turned<br \/>\ninto visual aids. If you want the jury to focus on seven pieces of<br \/>\nevidence, make a chart listing them one through seven, and then<br \/>\nshow it to the jury and use it with your witnesses or in your<br \/>\nargument. No one will ever complain that you were too<br \/>\norganized.<\/p>\n<p>Next is <strong>anaphora<\/strong>. Anaphora is a rhetorical<br \/>\ndevice that consists of repeating one or more words at the<br \/>\nbeginning of a series of related sentences or clauses. Countless<br \/>\nexamples can be found in law, literature and politics. Here are<br \/>\nthree famous ones:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Winston Churchill addressing his countrymen during<br \/>\nEngland&#8217;s dark days of World War Two. We shall defend our<br \/>\nisland, whatever the cost may be. We shall fight on the beaches. We<br \/>\nshall fight on the land and grounds. We shall fight in the fields<br \/>\nand in the streets. We shall fight in the hills. We shall never<br \/>\nsurrender.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Or Abraham Lincoln in his wonderful Gettysburg Address. But in<br \/>\nthe larger sense, we cannot dedicate, we cannot consecrate, we<br \/>\ncannot hollow this ground.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>And of course, Martin Luther King in his famous I Have a Dream<br \/>\nspeech. I have a dream that one day this nation will rise up and<br \/>\nlive out the true meaning of its creed. We hold these truths to be<br \/>\nself-evident, that all men are created equal. I have a dream that<br \/>\none day on the red hills of Georgia, the sons of former slaves and<br \/>\nthe sons of former slave owners will be able to sit down together<br \/>\nat the table of brotherhood. I have a dream that my four little<br \/>\nchildren will one day live in a nation where they will not be<br \/>\njudged by the color of their skin, but by the content of their<br \/>\ncharacter.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Anaphora sounds like a strange word, but yet it&#8217;s one of the<br \/>\nmost powerful and effective courtroom techniques. It adds emphasis<br \/>\nand order and often an element of drama. Moreover, it&#8217;s<br \/>\nseductive. It draws the listener in. It works in argument.<\/p>\n<p>&#8220;She did not mention that fact to the officer who responded<br \/>\nto the scene.&#8221;<\/p>\n<p>&#8220;She did not mention it to the officer who interviewed her<br \/>\nat the station an hour later.&#8221;<\/p>\n<p>&#8220;She did not mention it to anyone, anywhere at any time<br \/>\nover the next three months.&#8221;<\/p>\n<p>&#8220;And in cross-examination, did you mention that fact to the<br \/>\nofficer who responded to the scene?&#8221;<\/p>\n<p>&#8220;No, you did not.&#8221;<\/p>\n<p>&#8220;Did you mention that fact to the officer who interviewed<br \/>\nyou at the station?&#8221;<\/p>\n<p>&#8220;No, you did not.&#8221;<\/p>\n<p>&#8220;Did you mention that fact to anyone, anywhere at any time<br \/>\nover the next three months?&#8221;<\/p>\n<p>Next, <strong>rhetorical questions<\/strong>. Rhetorical<br \/>\nquestions are useful devices in both openings and closings. In<br \/>\nfact, they&#8217;re used so commonly that it&#8217;s rare to hear an<br \/>\nopening or closing without at least one. In openings, they can set<br \/>\nup issues, pique interest, or disguise argument.<\/p>\n<p>As you listen to the evidence ask yourself: why would someone<br \/>\nknowingly sign a false document if he had nothing to gain or<br \/>\nnothing to hide?<\/p>\n<p>In closing rhetorical questions add focus and interest.<\/p>\n<p>&#8220;Jane Smith says she spent thousands of dollars to fix the<br \/>\ndamage. But where are the bills? Where are the receipts? Where are<br \/>\nthe canceled checks? Where are the credit card<br \/>\nstatements?&#8221;<\/p>\n<p>Rhetorical questions are not, however, foolproof. Don&#8217;t ask<br \/>\na question if you&#8217;re just pitching a softball to your opponent<br \/>\nto hit it out of the park with a better answer than you have. And<br \/>\ndon&#8217;t ask a question that invites a juror to supply a harmful<br \/>\nanswer.<\/p>\n<p>&#8220;Ladies and gentlemen of the jury, who would believe such a<br \/>\nstory?&#8221;<\/p>\n<p>And Juror six is sitting there silently thinking, &#8220;Well, I<br \/>\nwould. It sounded right to me. Does he think I&#8217;m an<br \/>\nidiot?&#8221;<\/p>\n<p>One of the great challenges for trial lawyers is to connect<br \/>\nseparate pieces of evidence in a way that is both clear and<br \/>\npersuasive.
