Lucy Theobald at The Family Law Company examines a recent high-profile divorce case which has drawn national attention, not only for its eye-watering settlement of over \u00a3230 million ($307 million), but for the legal and ethical principles it highlighted.<\/p>\n

It what appears to be the third-largest divorce award in
\nEnglish legal history, Lucy Theobald (pictured), director at

The couple in question had been married for 20 years before
\nintroducing a post-nuptial agreement in 2023. The terms, heavily
\nweighted in the husband\u2019s favour, were expected by him to be
\nupheld. But the court took a different view. The judge found the
\nagreement to be neither complete nor conclusive, ultimately
\nruling that it had been secured under pressure and through
\ncoercive behaviour.<\/p>\n

The judge underlined the husband\u2019s attempt to undermine his
\nwife\u2019s trust in her legal representation by using scare tactics;
\na strategy which backfired. Such behaviour clearly compromised
\nthe wife”s ability to exercise her free will, severely weakening
\nany chance of the terms of the agreement to be taken into
\nconsideration by the court.<\/p>\n

This case, and its outcome, serves as a blunt reminder that no
\nmatter the scale of wealth involved, fairness must underpin any
\nfinancial settlement. When one party attempts to impose their
\nwill, especially through intimidation, manipulation or by
\nobstructing access to sound legal counsel, the integrity of any
\nagreement is at risk.<\/p>\n

It\u2019s not uncommon in high net worth relationships for one spouse,
\ntypically the more financially successful party, to exert undue
\ninfluence. Scornful suggestions that lawyers can\u2019t be trusted or
\n\u201cthis will only cost us more in fees,\u201d are likely to chip away at
\nthe other\u2019s confidence. Subtle threats may even be made, perhaps
\nin the form of inferences that pursuing legal advice or rejecting
\na proposed agreement will come at a personal or financial cost.<\/p>\n

Ascertaining conclusively that undue pressure has been applied
\nmay appear difficult, particularly if one party is unfamiliar
\nwith legal terminology, or English is not their first language.
\nHowever, an experienced legal team will painstakingly strive to
\nuncover if coercion has been applied.<\/p>\n

Courts take such dynamics seriously. If coercion is found to be a
\nfactor and a spouse\u2019s consent is shown to have been compromised,
\nthen even a formally signed agreement may carry little legal
\nweight. Judges are not persuaded by wealth or status. They are
\nguided by fairness.<\/p>\n

As unlikely as it sounds, it is entirely plausible for a spouse
\nto accept an agreement that isn\u2019t in their favour in full
\nunderstanding of the implications. However, should such a consent
\norder be filed, a judge is extremely likely to request firm
\nevidence that the spouse has genuinely agreed to the terms.<\/p>\n

It is important to note that English law does not currently
\nrecognise post-nuptial agreements as legally binding. However, if
\nthe legal conditions are met and an agreement reached without
\npressure then courts are more likely to take it into
\nconsideration. In the aforementioned case, the judge remarked
\nthat had both parties been “properly advised by independent
\nlawyers,” the court would have been “slow to interfere.”<\/p>\n

With that in mind, what does best practice look like?<\/p>\n

A fair post-nuptial agreement should:<\/p>\n

— Be drafted by a lawyer experienced in family and matrimonial
\nlaw;<\/p>\n

— Include full and frank disclosure of assets, liabilities,
\nincome, and expenditure from both parties;<\/p>\n

— Be signed voluntarily by both parties, without coercion or
\nundue influence;<\/p>\n

— Be written, not oral; and<\/p>\n

— Be built on terms that are fair and reasonable.<\/p>\n

Ideally, each party should instruct their own solicitor.
\nCollaborative law and mediation can also support constructive
\ncommunication, ensuring that any agreement is not only legally
\nrobust, but also ethically sound.<\/p>\n

It is not uncommon for a spouse to suggest to their former
\npartner that lawyers are only interested in their fees; however,
\nin this case, the husband’s undermining of the wife\u2019s
\nrelationship with her lawyer ultimately contributed to costs in
\nthe region of \u00a35.5 million,\u00a0a figure that could have been
\nsignificantly reduced had the process been approached openly and
\nfairly from the outset.<\/p>\n

Above all, this judgment is a powerful reminder that wealth does
\nnot bestow immunity from the law. The courts will always
\nprioritise fairness. Those entering into any form of marital
\nagreement would do well to remember that playing fair isn\u2019t just
\nmorally right, it\u2019s legally prudent too and can prevent years of
\nacrimony, anger, upset \u2013 and potentially unwanted publicity.<\/p>\n<\/div>\n\n
