{"id":273036,"date":"2025-12-16T08:44:37","date_gmt":"2025-12-16T08:44:37","guid":{"rendered":"https:\/\/dominiclevent.com\/blog\/?p=273036"},"modified":"2025-12-16T08:44:37","modified_gmt":"2025-12-16T08:44:37","slug":"business-groups-urge-tory-peers-to-stop-blocking-labours-workers-rights-bill-employment-law","status":"publish","type":"post","link":"https:\/\/dominiclevent.com\/blog\/business-groups-urge-tory-peers-to-stop-blocking-labours-workers-rights-bill-employment-law\/","title":{"rendered":"Business groups urge Tory peers to stop blocking Labour\u2019s workers\u2019 rights bill | Employment law"},"content":{"rendered":"\n<div>\n<p class=\"dcr-130mj7b\">Britain\u2019s biggest business groups have urged Conservative peers to stop blocking Labour\u2019s landmark workers\u2019 rights bill in the <a href=\"https:\/\/www.theguardian.com\/politics\/lords\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">House of Lords<\/a> to avoid throwing away a compromise deal reached with trade unions.<\/p>\n<p class=\"dcr-130mj7b\">With the clock ticking before Christmas, six of the country\u2019s biggest employers\u2019 groups warned that failure to pass the legislation before parliament rises on Thursday could put at risk a deal brokered with bosses and union leaders.<\/p>\n<p class=\"dcr-130mj7b\">In a letter to the business secretary, Peter Kyle, the employers\u2019 groups \u2013 the Confederation of British Industry, the British Chambers of Commerce, the Chartered Institute of Personnel and Development, the Federation of Small Businesses, the Recruitment and Employment Confederation, and Small Business Britain \u2013 wrote: \u201cNow is the time for parliament to pass the bill.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Labour staged a U-turn last month <a href=\"https:\/\/www.theguardian.com\/law\/2025\/nov\/27\/government-to-ditch-day-one-unfair-dismissal-policy-from-workers-rights-bill\" data-link-name=\"in body link\">to ditch a key manifesto pledge<\/a> guaranteeing workers protection against unfair dismissal from day one of employment, instead of the current two-year waiting period.<\/p>\n<p class=\"dcr-130mj7b\">In a deal with most trade union leaders, ministers tabled a six-month period as a compromise \u2013 despite the climbdown triggering <a href=\"https:\/\/www.theguardian.com\/politics\/2025\/nov\/28\/labour-mps-attack-starmer-u-turn-over-workers-rights-as-complete-betrayal\" data-link-name=\"in body link\">backbench anger<\/a> among some Labour MPs who accused Keir Starmer\u2019s government of betrayal.<\/p>\n<p class=\"dcr-130mj7b\">However, peers voted down the bill for a fourth consecutive time, imposing amendments tabled by Tory peers protesting against a concession made as part of the deal to lift a cap on compensation claims for unfair dismissal.<\/p>\n<p class=\"dcr-130mj7b\">It comes as some business leaders warned lifting the cap could enable some high earners to secure unlimited compensation.<\/p>\n<p>Workers can currently only receive payouts equivalent to the lower of their annual salary or \u00a3118,223 if they win a claim for ordinary unfair dismissal.<\/p>\n<p class=\"dcr-130mj7b\">TheCityUK \u2013 which represents banks and other financial services companies \u2013 has written to ministers after the surprise <a href=\"https:\/\/www.theguardian.com\/law\/2025\/dec\/11\/downing-street-vows-to-force-employment-rights-bill-through-lords\" data-link-name=\"in body link\">amendment to the employment rights bill<\/a> left its members feeling blindsided, and fearing open-ended payouts for highly paid staff, a source familiar with the letter told the Guardian.<\/p>\n<p class=\"dcr-130mj7b\">TheCityUK\u2019s members, which employ some of the UK\u2019s highest-paid staff in areas such as investment banking, warned it could create an avenue for well-paid bankers or City executives to secure big windfalls if they can successfully argue that they were unfairly fired.<\/p>\n<p class=\"dcr-130mj7b\">Those prospects could deter companies from investing in the UK and could make bosses more hesitant to take a chance on hires, the lobby group has warned ministers.<\/p>\n<p class=\"dcr-130mj7b\">Ministers vowed there would be no further compromises in an attempt to force through the legislation before Christmas, with sources suggesting further sittings of parliament could be used.<\/p>\n<p class=\"dcr-130mj7b\">The bill is expected to be passed without any amendments in the Commons on Monday and will be back in the Lords on Tuesday. If peers insist on tabling further amendments, the bill would need to again pass back and forth between the two houses before it receives royal assent.<\/p>\n<p class=\"dcr-130mj7b\">Writing in their letter to Kyle, the business groups said they wanted to focus on securing compromises from the government in the phase of secondary legislation that would follow the primary passage of the bill. Kyle has pledged to listen to bosses concerns and to hold a series of 26 consultations after the bill becomes law.<\/p>\n<p class=\"dcr-130mj7b\">The lobby groups warned that blocking the bill could put cooperation between business leaders, the government and trade unions at risk, and could lead to the loss of the six-month compromise.<\/p>\n<figure class=\"dcr-173mewl\" data-spacefinder-role=\"inline\" data-spacefinder-type=\"model.dotcomrendering.pageElements.NewsletterSignupBlockElement\"><\/figure>\n<p class=\"dcr-130mj7b\">\u201cWe believe that the best way forward is to keep working with the government and trade unions to find balanced solutions through secondary legislation.
