AN ex-wife who complained her \u00a310million divorce settlement was not enough has lost out on her\u00a0\u00a3175k yearly payments after a failed bid to claim more money.<\/p>\n

Kim Waggott was handed \u00a39.76million after splitting from her super-rich husband, allowing her to purchase a \u00a32million home near Chester and a Balearic holiday home.<\/p>\n

Kim Waggott, 49, has lost out after a bid to get a more generous annual allowance from her multimillionaire ex<\/figcaption><\/figure>\n

She was also awarded \u00a3175,000 in annual maintenance payments for the rest of her life following the split with her cheating husband William in 2012.<\/p>\n

Not happy with the deal, the 49-year-old was back in court this year demanding a \u00a323,000-a-year increase in annual maintenance payments.<\/p>\n

But her attempt to have a “meal ticket for life” has backfired after a High Court Judge ruled her current payments should stop after just three years.<\/p>\n

Mr Waggott, the finance director of TUI travel who had two affairs before the pair’s divorce, protested the original ruling, saying it meant his ex-wife had “no financial incentive” to get back to work.<\/p>\n

Now Lord Justice Moylan, at London’s Appeal Court, has ruled payments should stop from March 2021 to guarantee Mr Waggott a “clean break” from his ex.<\/p>\n

The couple, who have one daughter, were married for 21 years and lived in a “very substantial” \u00a34.3m property near Great Missenden, Bucks.<\/p>\n

After their split Mr Waggott moved into a \u00a31.9m farm near St Albans “with another lady,” the Court of Appeal was told by Mrs Waggott’s lawyers.<\/p>\n

Nigel Dyer QC, for the husband, argued that the maintenance order should be terminated.<\/p>\n

He asked the judges: “How long should an order based on sharing last for? When does the meter stop ticking?<\/p>\n

“It is unfair to expect the husband to continue working long hours in demanding employment and not expect the wife to realise her earning potential as soon as is reasonably practicable.”<\/p>\n

Allowing the husband’s appeal today, Lord Justice Moylan said: “The expression ‘meal ticket for life’ can be used as an unfair trope.<\/p>\n

“I, of course, acknowledge that long-term maintenance can be required as part of a fair outcome (in a divorce.)<\/p>\n

“But it is plain to me that the wife would be able to adjust without undue hardship to the termination of maintenance.”<\/p>\n

Lord Justice Moylan said that the wife would be able to make up the “shortfall” created by the loss of the maintenance payments by investing \u00a3950,000 – roughly 10 per cent – of her massive payout and living off the interest.<\/p>\n

Mrs Waggott’s lawyers had argued that she ought not to have to invest any part of her payout to create an income for herself.<\/p>\n

“Any extension of the sharing principle to post separation earnings would fundamentally undermine the court’s ability to effect a clean break.”<\/p>\n

In January, TV presenter Ant McPartlin<\/a> pledged to part with a record \u00a331million divorce settlement to avoid a messy court battle following his split from Lisa, his wife of eleven years.<\/p>\n\n
