\n Posted A twice-convicted drug trafficker who argued her children would suffer separation hardship if she was sentenced to a term of imprisonment has been spared jail time after a successful appeal.<\/p>\n Sorayah Louise Constant, 32, was sentenced to jail for at least 18 months<\/a> for drug offences in April last year, with her crimes breaching a previous good behaviour bond for drug trafficking.<\/p>\n The District Court heard she placed orders for various medications from overseas containing pseudoephedrine, which could have produced $102,000 worth of methamphetamine.<\/p>\n She had an 18-month-old baby and was pregnant with her second child when she was originally sentenced.<\/p>\n The Court of Criminal Appeal set aside her sentence<\/a> after her lawyer Heather Stokes argued leniency was warranted because there was no mothers’ and babies’ facility in Adelaide’s women’s prison.<\/p>\n Today, Constant had her sentence suspended on an 18 month good behaviour bond.<\/p>\n Under the terms of her release, she will be under the supervision of a corrections officer for four months and required to undergo drug and rehabilitation counselling.<\/p>\n Constant smiled and wiped away tears of joy as the sentence was handed down.<\/p>\n Justice Kevin Nicholson was short in his remarks.<\/p>\n “This has been a long process you’ve been through, I think it’s plain to you what you have to do in the future,” he said.<\/p>\n<\/blockquote>\n Outside court, Ms Stokes said her client was overwhelmed with emotion and relief.<\/p>\n “She has never known for sure that she would be free until we got to today,” she said.<\/p>\n “She earned it, by her own actions she’s earned it.<\/p>\n “She hasn’t used drugs since she got pregnant with the first child and unlike some, she has stuck with that.”<\/p>\n Ms Stokes said the new sentence would allow Constant to move interstate in four months’ time where her partner and eldest child currently reside.<\/p>\n “It will help make a new start in New South Wales,” she said.<\/p>\n “The old memories can dissipate into the background.”<\/p>\n \n\tTopics:<\/strong><\/p>\n \tcourts-and-trials<\/a>,<\/p>\n \tlaw-crime-and-justice<\/a>,<\/p>\n \tdrug-offences<\/a>,<\/p>\n \tcrime<\/a>,<\/p>\n \tprisons-and-punishment<\/a>,<\/p>\n \tadelaide-5000<\/a>,<\/p>\n
