After five wears, it appeared the heat of the mouth had remoulded the plastic.<\/p>\n<p>A third pair was offered, but he was told by a customer service manager that the warranty was up and he was only receiving another pair as a goodwill gesture.<\/p>\n<p>Sean said the package was wrapped tightly in foil and looked suspicious. When he opened it, he believed it was the first pair he originally received.<\/p>\n<p>He said: \u201cI thought it was disgusting how they thought they could do that,\u201d<\/p>\n<p>After numerous letters to Instasmile got him nowhere Sean took the matter to court where he was awarded a full refund.<\/p>\n<aside class=\"read-more-links\">\n<h5 class=\"publication-theme-icon publication-theme-border\">Read More<\/h5>\n<\/aside>\n<p>Instasmile, part of the Denlab portfolio, has now refunded Sean the full amount.<\/p>\n<p>Sean said that while the process might be a long one, the law is on the consumer\u2019s side.<\/p>\n<p>He said: \u201cPeople should stand up for their rights and not be fobbed off by companies. if you believe them to be in the wrong, do a bit of research, call the Citizens Advice, gather evidence to support you just in case you have to pursue it via the legal system.<\/p>\n<p>\u201cDon\u2019t let the formal process scare you off, especially the civil court proceedings.
