IF Prince Harry and Meghan Markle decide to have kids, you might be interested to learn that they won\u2019t actually have full custody of them.<\/p>\n

According to a royal expert, the Royal Family have an unusual agreement with the Queen, 92, that she actually has full legal custody over all minor royals.<\/p>\n

Prince Harry and Meghan Markle will not have full custody of their kids should they have them<\/figcaption><\/figure>\n

This means that Prince William and Kate Middleton also don\u2019t have full custody over their kids, Prince George, five, Princess Charlotte, three, and three-month-old Prince Louis.<\/p>\n

Royal expert Marlene Koenig told the Sun Online: \u201cThe sovereign has legal custody of the minor grandchildren.<\/p>\n

\u201cLegislation passed during the reign of George I.\u00a0It was known as The Grand Opinion for the Prerogative Concerning the Royal Family and it was about the King\u2019s control over the education, the raising and the marriage of his grandchildren.<\/p>\n

\u201cHe did it because he had a very poor relationship with his son, the future King George II, so they had this law passed that meant the King was the guardian of his grandchildren.\u201d<\/p>\n

The Queen holds custody over the kids and this will pass onto Prince Charles when she dies<\/figcaption><\/figure>\n

The ancient law dates back over 300 years to 1717 when the monarch\u2019s \u201cright of supervision extended to his grandchildren and this right of right belongs to His Majesty, King of the Realm, even during their father\u2019s lifetime\u201d.<\/p>\n

This means that when the Queen dies, the custody of royal minors would pass onto Prince Charles.<\/p>\n

Marlene advised that the law still exists today, and has recently affected the way the royals parent their kids.<\/p>\n

She said: \u201cWhen Harry was an infant, Charles asked the Queen if he and Diana could travel with both kids to Scotland (on a plane). The Queen said yes.<\/p>\n

\u201cLater, as Harry got older, he would fly with parents, and William would travel separately.<\/p>\n

\u201cTechnically, they needed permission for travel. The Queen has the last word on parenting decisions like that.\u201d<\/p>\n

The bizarre law is allegedly said to have prevented Princess Diana from flying to Australia with her kids before her death as she didn’t have legal custody.<\/p>\n

When Princess Diana and Prince Charles went through their very high-profile divorce in 1996, the law was reportedly taken into consideration.<\/p>\n

Marlene said: \u201cNeither the Wales\u2019 or Yorks\u2019 divorces dealt with actual custody of their children because of this law.<\/p>\n

\u201cCharles and Diana each saw their sons about 40 days a year after the separation.<\/p>\n

\u201cCharles and Diana certainly talked to the queen about their kids\u2019 education. The Queen was unlikely to push her views.\u00a0 She would respect the parents\u2019 wishes.\u201d<\/p>\n

Constitutional expert Michael L. Nash wrote in The Times in 1993 that the “Queen has the last word in the custody upbringing, education and even the right of abode of the princes, even during the lifetime of their father, Prince Charles.<\/p>\n

“As for their mother, the Princess of Wales, her say is a matter of discretion and negotiation.”<\/p>\n

While the law is technically still in existence, Marlene said it typically is a \u201cformality and nothing more\u201d.<\/p>\n

She added: \u201cThe grand opinion has never been changed, but the Queen has a far better relationship with her kids than George I had with his son, the future George II.\u201d<\/p>\n

Buckingham Palace was contacted by the Sun Online and declined to comment.<\/p>\n
