Perturbed by how this project could change their way of life, residents organized and collectively <a href=\"http:\/\/www.washingtoncitypaper.com\/news\/housing-complex\/article\/20839925\/coliving-space-threatens-to-change-the-quaint-richardson-place-nw\" target=\"_blank\">cried foul<\/a>.<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Now those residents are cautiously celebrating a recent decision by D.C. zoning officials. They object to an upscale co-living project by local developer Oaktree and New York-based startup Common, a company that manages eight co-living developments in NYC and San Francisco. <\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Common\u2019s debut D.C. project, on Richardson Place, is a three-story structure featuring 24 furnished bedrooms that measure between 120 and 140 square feet each, with private bathrooms. Memberships for the property, described by Common as in \u201ccharming Shaw,\u201d start at $1,700 a month. (\u201cShaw feels like home in the nation\u2019s nerve center,\u201d Common\u2019s website says.) Tenants also get weekly cleaning, shared kitchen and bathroom supplies, and access to other Common locations. Utilities are included, and the startup says it currently has more than 120 members nationally.<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">On May 17, Oaktree and Common suffered a major setback when the Board of Zoning Adjustment upheld the Richardson Place Neighborhood Association\u2019s <a href=\"http:\/\/www.washingtoncitypaper.com\/news\/housing-complex\/blog\/20847434\/neighbors-appeal-dc-building-permits-for-planned-coliving-space-in-truxton-circle\" target=\"_blank\">appeal<\/a> of building permits for the team\u2019s project.\u00a0<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">BZA officials expressed concern that the project isn\u2019t allowed under the existing zoning code.\u00a0<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Additionally, some residents remain uncomfortable with how these developments could affect neighborhood character and density. Zoning officials even debated what a \u201cdwelling\u201d and a \u201cfamily\u201d constitute under D.C. law during the BZA\u2019s deliberations about the Richardson Place project, which is <a href=\"https:\/\/www.washingtonpost.com\/realestate\/the-group-house-grows-up-in-washington\/2017\/04\/12\/88eec026-1e13-11e7-a0a7-8b2a45e3dc84_story.html?utm_term=.d889ccd78cc1\" target=\"_blank\">one of few co-living spaces<\/a> that have emerged in the District as entrepreneurial property firms target its millennial-rich real estate market.\u00a0<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Despite the unfavorable zoning ruling, Common continues to <a href=\"https:\/\/washingtondc.craigslist.org\/search\/doc\/roo?query=Richardson&amp;availabilityMode=0\" target=\"_blank\">advertise<\/a> its D.C. units <a href=\"https:\/\/www.common.com\/richardson\/\" target=\"_blank\">online<\/a>. What\u2019s more, tenants have been co-living at the new property since earlier this year, when Common launched leases, because the BZA\u2019s recent decision occurred after the Department of Consumer and Regulatory Affairs had issued the developer certificates of occupancy.<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">The local neighborhood commission and Ward 5 Councilmember <\/span><span class=\"s2\"><b>Kenyan McDuffie<\/b><\/span><span class=\"s1\"> supported the neighbors\u2019 appeal.<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">\u201cIn reality, what [the landlord is] doing is operating a commercial property in a residentially zoned area without trying to get any variances or have any community input,\u201d says <\/span><span class=\"s2\"><b>Katherine McClelland<\/b><\/span><span class=\"s1\">, one of the commissioners. She has resided across the street from the site with her husband for over a year, and adds that she\u2019s not opposed to co-living in principle: \u201cIf a complex like this was on Florida or Rhode Island [Avenue NW], there wouldn\u2019t be an issue.\u201d\u00a0<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Proponents say co-living spaces satisfy a hunger for more social alternatives to traditional group homes and also help meet some of the robust demand for housing in the District. In the case of Common\u2019s property, the land upon which the structure sits used to be an empty, mosquito-prone lot. Oaktree renovated a structure that the previous owner had built, converting it to its present form.<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Against this backdrop, the zoning board granted the neighborhood association\u2019s appeal three to one, with one seat vacant. BZA Vice Chair <\/span><span class=\"s2\"><b>Carlton Hart<\/b><\/span><span class=\"s1\">, the lone dissenter, said the project met the applicable standard for \u201cfamilies\u201d\u2014of no more than six people in total\u2014\u201cliving independently\u201d from each other for a properly permitted \u201ctwo-family dwelling\u201d or \u201cflat.\u201d\u00a0<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Oaktree categorized the property, which is comprised of two adjacent addresses, as two flats with two 6-bedroom units in each.\u00a0<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">Got that? \u201cIt seems as though this, what\u2019s being proposed, is somewhat in the middle of a lot of different things, which is why I think folks are kind of struggling with it,\u201d Hart said at the meeting.<\/span><\/p>\n<p class=\"p5\"><span class=\"s2\"><b>Anthony Hood<\/b><\/span><span class=\"s1\">, who serves as chair of the D.C. Zoning Commission and was filling a BZA spot when the decision came down, convinced the other board members to greenlight the neighbors\u2019 appeal. He said the project could \u201cchange the character of the neighborhood,\u201d and that allowing it to operate would exceed the zoning normally permitted in the immediate area.\u00a0<\/span><\/p>\n<p class=\"p5\">\u201cI want to make sure that [DCRA\u2019s] Zoning Administrator is not, first of all, changing the zone plan,\u201d Hood noted. \u201cAnd I think proceeding with this \u2026 I think he does that here.\u201d\u00a0<\/p>\n<p class=\"p5\">Oaktree and Common maintain that they have followed District regulations and are acting within their rights. Although Oaktree partner <span class=\"s2\"><b>Peter Stuart<\/b><\/span> declined to comment on the record, citing respect for the zoning process at play, Common CEO <span class=\"s2\"><b>Brad Hargreaves<\/b><\/span> says in a statement that \u201cwe are committed to being great neighbors on Richardson Place and are excited to welcome our first residents to the D.C. community.\u201d He adds that his company, established in 2015 with backing from venture capital firms, and Oaktree, are \u201cconfident in [their] legal position.\u201d<\/p>\n<p class=\"p5\"><span class=\"s1\">What the board\u2019s decision means in practical\u2014and precedential\u2014terms is still unclear. \u201cI have no issues with the people who are living there, but I\u2019d feel badly if they have to move out without fair notice,\u201d McClelland says.\u00a0<\/span><\/p>\n<p class=\"p5\">The D.C. Attorney General\u2019s office must submit a written, draft order of the ruling to the BZA, which in turn has to sign it and send it to the parties in the case. Statutes stipulate that the board\u2019s orders only take effect 10 days after these steps have been finalized. This could take half a year to unfold. A representative for the BZA says in an email that \u201crecently, drafts from [the Attorney General\u2019s office] take an average of 3 to 6 months to complete because of other outstanding draft orders.\u201d<\/p>\n<p class=\"p5\"><span class=\"s1\">Moreover, the team behind the co-living development could challenge the board\u2019s ruling in the D.C. Court of Appeals\u2014the highest court for the District\u2014as has happened in <a href=\"http:\/\/dc.urbanturf.com\/articles\/blog\/dc_court_of_appeals_reverses_approvals_for_blagden_alley_micro-units\/12026\" target=\"_blank\">other<\/a> disputed zoning cases. Due process means the feud on Richardson Place could persist for a few years to come.
