Toskos said he has allowed interested parties to intervene in other affordable housing declaratory judgment cases.<\/p>\n<p class=\"p-text\">Montvale\u2019s own declaratory judgment has intervenors, including Fair Share Housing Center, an affordable housing advocacy group, and Hornrock Properties, owner of the Sony lot, a portion of which is in Montvale.<\/p>\n<p class=\"p-text\">Further, the judge said he is hopeful that allowing Hekemian to intervene will assist in the borough\u2019s affordable housing litigation, allowing the parties to talk to each other and come to a resolution.<\/p>\n<p class=\"p-text\">Hekemian owns the 37-acre Mercedes property and\u00a0has been\u00a0in negotiations with the borough since early 2016 to rezone the lots to allow mixed-use retail and residential development, a change that was recommended to the council by the borough Planning Board.<\/p>\n<div id=\"module-position-QKHrcNbtuoQ\" class=\"story-asset video-asset\">\n<div class=\"ui-video-wrapper \" itemprop=\"video\" itemscope=\"\" itemtype=\"http:\/\/schema.org\/VideoObject\">\n<div class=\"js-ui-video-init ui-pluto-video js-video-aps js-ui-pluto-video story-video inline-story-video smallarticleinlinehtml5\" style=\"width: 540px; height: 304px;\" data-video-id=\"102826128\">\n<div class=\"ui-pluto-still\"><img decoding=\"async\" src=\"https:\/\/www.gannett-cdn.com\/-mm-\/a1c43fa32871d7739bb9c7c146638dc537dd770e\/r=540\/https\/videos.gannett-cdn.com\/bergen\/images\/5114477740001\/201706\/2088\/5114477740001_5469989568001_5469972180001-vs.jpg\" width=\"540px\" height=\"304px\" class=\"ui-pluto-still-img\"\/><\/div>\n<div class=\"js-ptb pluto-title-bar\">\n<div class=\"js-ptb-close pluto-title-bar-vcenter pluto-title-bar-close\">\n<div>CLOSE<img decoding=\"async\" class=\"pluto-title-bar-close-icon\" src=\"https:\/\/www.gannett-cdn.com\/uxstatic\/northjersey\/uscp-web-static-2701.0\/images\/sprites\/icon_close.png\"\/><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ui-video-controls story-video inline-story-video\" style=\"width: 540px;\">\n<p class=\"video-desc\" itemprop=\"description\">\n    Montvale Mayor Mike Ghassali discusses rezoning the soon-to-be-vacant Mercedes-Benz USA property before a meeting in April.<br \/>\n    <span class=\"credit\">Sarah Nolan\/NorthJersey.com<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"p-text\">But in June, to Hekemian\u2019s surprise, Montvale voted down a zoning change that would have allowed it to build up to 300 units of housing on the property.<\/p>\n<p class=\"p-text\">Days later, the developer filed to intervene in the borough\u2019s declaratory judgment and is seeking court approval to build as many as 1,000 units on the site.<\/p>\n<p class=\"p-text\">Surenian said Friday that Hekemian is \u201cnot here to help with affordable housing, but for leverage.\u201d He added that developers with deep pockets can use the litigation process to drive municipalities into submission.<\/p>\n<p class=\"p-text\">Ira Weiner, an attorney representing Hekemian, said his client has testimony and evidence regarding the Mercedes property that will help the judge decide whether or not Montvale\u2019s plan for affordable housing is constitutional.<\/p>\n<p class=\"p-text\">Weiner added that the Mercedes property was not included in Montvale\u2019s vacant land adjustment for how many units of affordable housing it should have to provide.<\/p>\n<p class=\"p-text\">\u201cTheir own board recommended a mixed-use overlay zone for this property,\u201d Weiner said.<\/p>\n<p class=\"p-text\">Montvale submitted its plan to comply with affordable housing regulations to the judge in May and is awaiting a response from Fair Share Housing Center.
