‘Irrational’: victory for Law Society in challenge to criminal legal aid fees policy
The Law Society has declared victory in its High Court battle against the government over criminal legal aid fees. Chancery Lane took the government to court over the decision not to raise criminal legal aid fees by the minimum 15% recommended by the independent criminal legal aid review in December 2021. The Society argued that the lord chancellor: breached the duty to provide criminal legal aid in accordance with section 1 of LASPO (ground one); acted irrationally (ground two); failed to provide adequate reasons (ground three); and breached the duty to make adequate enquiries (ground four). In a landmark 61-page judgment handed […]
“The new PPI” – is car finance mis-selling the next big litigation wave?
Car sales: Finance mis-selling under spotlight Claims over mis-sold car finance are shaping up to be the big new growth area for consumer litigation practices, with Pogust Goodhead launching myfinanceclaim.com. Following mydieselclaim.com, which it advertised aggressively in wake of the car emissions scandal, the firm is telling consumers who used car finance that they could be in line to recover up to £4,000. It comes in the wake of the Financial Conduct Authority (FCA) announcing earlier this month that it was assessing the extent of the problem. This in turn followed the Financial Ombudsman Service issuing its first two final […]

Proportion of married people in England and Wales falls below 50% for first time | Marriage
The proportion of people aged 16 or older in England and Wales who are married or in a civil partnership has fallen below 50% for the first time. The figure dropped to 49.4% in 2022, according to the latest estimates from the Office for National Statistics (ONS). This was down from 49.7% in 2021 and 51.2% a decade earlier in 2012. The previous release on population estimates by marital status and living arrangements across the two nations covered estimates for 2020, so Thursday’s release is the first showing figures for 2021 and last year. The ONS said comparable records go […]

How to Get Over A Divorce: Stop Playing the Victim!
Want to know how to get over a divorce? I have some advice. When I was first getting divorced, I was depressed. I was sad, I was scared, but mostly I was angry. ‘Why did this happen to me?’ and ‘It’s not fair’ were constantly going through my mind. I felt like somehow I was terribly wronged. By everyone. Occasionally, I found myself with a “Whoa is me… Feel sorry for me” attitude. “I’m a single mom. Finances are tight…I’m alone…” After some time went by, I started to realize something: focusing on being angry, bitter, sad, and wronged wasn’t […]
How to Rebuild Your Life after Divorce at 50
How do you rebuild your life after divorce at 50? It takes time and it’s a long journey, but it can be wonderful! Let me start by saying that when facing divorce, you have a choice. You can let the divorce define you and choose to believe you are a failure, or you can use the life-changing event as an opportunity to learn, to grow, and do the work to become the best version of yourself. Norton Rose Fulbright’s 19th Annual Litigation Trends Survey: heightened risk around cybersecurity a…
Global law firm Norton Rose Fulbright’s 19th Annual Litigation Trends Survey, released today, finds that risks and evolving regulation around technology and cybersecurity dominate corporate counsel concerns heading into 2024, as cyberattacks and a patchwork of data privacy laws deepen litigation exposure. Forty percent of respondents said their exposure to cybersecurity and data protection disputes increased in 2023 – more than any other category – and those risks appear here to stay, with that area also topping the list of 2024 litigation concerns amid mounting challenges posed by data management and artificial intelligence (AI). Questions surrounding AI’s role in patent inventorship, copyright […]
Safeguards are needed against the abuse of private prosecutions, the Post Office scandal shows
Before the latest Post Office headlines swept across the country, I expect very few people were aware that the law allows any adult, or organisation, to bring a private prosecution. In light of the Horizon scandal, the next question must surely be: how do we guard against abuse? The Bar Council, representing almost 18,000 barristers in England and Wales, last week called for parliament to review the safeguards associated with private prosecutions. The Post Office Horizon scandal is one of the worst miscarriages of justice our country has seen and focus rightly turns to the circumstances in which the private […]
