Falling hurts; so does litigation

In an old “Looney Tunes” bit, a school-age Elmer Fudd walks off a precipice but does not fall. He hadn’t learned gravity yet. A young Bugs Bunny gives him the book Gravity for Beginners, and you can guess what happens next. Real life is not as forgiving as animation. What happens when you can’t tell or don’t realize that the gap in your path is actually a cliff? This month’s column, the first in a two-part series, provides a primer on ordinary negligence and litigation to shed light on terrain you may not realize is riddled with professional liability cliffs. Mulheron: Funding supports the regulatory objectives Litigation funding supports the public interest and access to justice but will remain niche in aiding consumers, according to major research which identified 44 cases in the last five years. The Legal Services Board (LSB) commissioned Professor Rachael Mulheron KC (Hon) of Queen Mary University in London, the leading academic […]

The Ministry of Justice has been told to ‘get a grip’ on the courts crisis after the National Audit Office today branded as unachievable the government’s stated ambition of bringing the Crown court backlog down to 53,000 by next March. The public spending watchdog decided to investigate after the backlog reached a record high of 67,573 in December. ‘While the MoJ confirmed publicly in April 2024 that it remained committed to the ambition, its most recent projection in September 2023 suggested that there could be 64,000 cases in March 2025, 11,000 higher than its projection in October 2021 when the […]

Mis-sold commercial energy claims are on the rise nationwide, but leading litigation experts are warning there could be thousands of small businesses who still have no idea they have been targeted. Earlier this year, North Tyneside-based Business Energy Claims (BEC) hit the headlines after helping recover more than £14,000 for a small amusement arcade business after energy provider Engie was found liable for failing to disclose the commission a broker was making from the contract. The groundbreaking ruling against Engie opened the floodgates for further claims from businesses which have found themselves in a similar position – but this appears […]
