Alice and Mark, parents to two young children, always struggled with the idea of traditional divorce, especially […]

A recent study indicates that women in England and Wales who have gone through domestic abuse face greater financial insecurity compared to other women after divorce and beyond. The research, conducted by the University of Bristol and supported by the Nuffield Foundation, also highlights the critical role of the legal system for survivors of domestic violence and the insufficiency of legal aid in aiding their financial matters during divorce. Prior to this study, the financial arrangements made by divorcing couples had not been thoroughly investigated. The findings show that many divorcees possess surprisingly limited assets to divide, with women who […]

The Civil Procedure Rules (CPR), which govern civil litigation in the English courts, have been updated to give greater effect to a landmark Court of Appeal ruling last year, Churchill v Merthyr Tydfil. In that case, the court found that judges have the power to ‘stay’ – or pause – court proceedings so that the parties can attempt to resolve their disputes through mediation or another form of alternative dispute resolution (ADR). The court can even positively require parties to engage in ADR. The updates are part of a wider drive in the English courts to encourage parties to […]

This kind of advice and divorce strategy often leans toward an aggressive, win-at-all-costs approach, steeped in stories about what disaster can result if you’re not combative enough. But […]

Children are at risk of being wrongly removed from their parents’ care by the family courts because drug tests are being misinterpreted, experts have warned. Life-changing decisions about whether a child should be placed in the care of a local authority can sometimes hinge on the outcome of hair-strand tests, designed to show whether a parent has consumed drugs or excessive alcohol. But the process used to interpret the results can be misleading and carries a risk of racial bias, according to lawyers and campaigners. Paul Hunter, an expert in the field of drug testing, told The Bureau of Investigative […]
